{"id":20313,"date":"2015-06-01T00:00:00","date_gmt":"2015-06-01T05:00:00","guid":{"rendered":"https:\/\/www.dejusticia.org\/the-truth-commissions-advances-and-challenges\/"},"modified":"2017-02-21T17:00:56","modified_gmt":"2017-02-21T22:00:56","slug":"the-truth-commissions-advances-and-challenges","status":"publish","type":"post","link":"https:\/\/develop.dejusticia.org\/en\/the-truth-commissions-advances-and-challenges\/","title":{"rendered":"The Truth Commission&#8217;s Advances and Challenges"},"content":{"rendered":"<p>En un comunicado conjunto del Gobierno y las Farc, la mesa de negociaci&oacute;n anunci&oacute; el establecimiento de la Comisi&oacute;n para el Esclarecimiento de la Verdad, la Convivencia y la No repetici&oacute;n, una vez se firme el acuerdo final. Esta Comisi&oacute;n tendr&iacute;a como objetivo principal reconstruir la verdad sobre lo ocurrido en el conflicto: un relato nacional que a&uacute;n est&aacute; incompleto y nos servir&iacute;a como sociedad para entender mejor la historia de la guerra, pero sobre todo, que le servir&iacute;a a las v&iacute;ctimas y a los familiares de los muertos y desaparecidos para cerrar una herida abierta y poder empezar a vivir de nuevo.<\/p>\n<p>Seguramente lo m&aacute;s valioso del modelo de Comisi&oacute;n que propone la mesa sea el enfoque de involucrar en la reconstrucci&oacute;n de la historia a m&uacute;ltiples actores y no solo a las Farc: la Comisi&oacute;n busca que tambi&eacute;n al Estado, los paramilitares, las otras guerrillas y los m&uacute;ltiples actores privados que pudieron haberse beneficiado de los grupos violentos hablen y reconozcan su responsabilidad. Este acuerdo adem&aacute;s, pone a las v&iacute;ctimas en el centro del proceso de verdad: como est&aacute; planteada la Comisi&oacute;n, las v&iacute;ctimas deber&aacute;n participar en la selecci&oacute;n de los comisionados y tambi&eacute;n en la recolecci&oacute;n de datos.<\/p>\n<p>No es la primera vez, sin embargo, que el pa&iacute;s se propone la reconstrucci&oacute;n de esta historia. Anteriormente se han realizado esfuerzos parciales a trav&eacute;s de instancias como el Centro de Memoria Hist&oacute;rica que es necesario tener en cuenta y no dejar por fuera para completar la tarea.<\/p>\n<p>Como est&aacute; planteado el acuerdo, la dificultad principal ser&iacute;a c&oacute;mo este relato va a generar justicia, pues la Comisi&oacute;n no tiene funciones jur&iacute;dicas. Y si bien el esclarecimiento de la verdad es importante, para que este tenga un efecto es necesario que tambi&eacute;n se avance en justicia. Es urgente que se avance en el otro brazo del sistema: las medidas sobre justicia y responsabilidad individual.&nbsp;<\/p>\n<p>&iquest;C&oacute;mo podr&iacute;an entonces sincronizarse estos dos procesos? &iquest;Habr&iacute;a que iniciar un proceso paralelo de judicializaci&oacute;n o habr&iacute;a que esperar los tres a&ntilde;os que va a durar la Comisi&oacute;n para empezar a hacerlo? A&uacute;n no es clara la manera como esto se llevar&aacute; a cabo.<\/p>\n<p>Tambi&eacute;n es importante se&ntilde;alar que ser&iacute;a prudente no sobrecargar un mismo mecanismo. En el comunicado, la mesa de negociaci&oacute;n plantea que la Comisi&oacute;n estar&iacute;a encargada de cumplir tres objetivos distintos: (1) contribuir al esclarecimiento de lo ocurrido, (2) promover y contribuir al reconocimiento de las v&iacute;ctimas, y (3) promover la convivencia de los territorios para consolidar el respeto y la confianza en aras de que esto vuelva a suceder en un futuro. Podr&iacute;a resultar demasiado para un lapso de tres a&ntilde;os y ser&iacute;a m&aacute;s eficiente concentrar en menos cosas la herramienta en lugar de dispersarla.<\/p>\n<p>Por &uacute;ltimo, es fundamental entender la Comisi&oacute;n de la Verdad como el comienzo de un proceso social de verdad y no como una tarea que va a culminar en la publicaci&oacute;n de un informe. &nbsp;La verdad es un ejercicio y para que la Comisi&oacute;n cumpla su ciclo ser&aacute; necesaria la apropiaci&oacute;n social de la narrativa del conflicto. Hay que pensar en que en el momento de obtener un informe en realidad a penas estar&iacute;amos empezando el proceso.
