El Colectivo de Estudios Drogas y Derecho (CEDD) lanza nuevos estudios mostrando que a pesar del debate en America Latina sobre la necesidad de repensar las pol\u00edticas de drogas, el encarcelamiento masivo por delitos de drogas no violentos ha aumentado a nivel regional. Los cinco informes tem\u00e1ticos analizan el discurso y realidad en la reforma de pol\u00edticas de drogas, la criminalizaci\u00f3n del consumo, alternativas al encarcelamiento, mujeres encarceladas por delitos de drogas y adolescentes y j\u00f3venes privados de libertad por drogas en Am\u00e9rica Latina.<\/p>\n

\u201cEn la mayor\u00eda de los pa\u00edses de Am\u00e9rica Latina estudiados, 1 de cada 5 personas en prisi\u00f3n est\u00e1 por delitos de drogas. Adem\u00e1s, la poblaci\u00f3n encarcelada por drogas en varios de esos pa\u00edses ha aumentado en mayor proporci\u00f3n que la poblaci\u00f3n penitenciaria en general\u201d,destaca Alejandro Corda, investigador del CEDD de Argentina. \u201cSin embargo, eso no tiene ning\u00fan impacto en el negocio de las drogas dado que las personas en prisi\u00f3n por delitos de drogas son actores menores del tr\u00e1fico, fungibles, y en situaciones de vulnerabilidad\u201d.<\/p>\n

En Colombia, este porcentaje casi se cuadriplic\u00f3 en los \u00faltimos 14 a\u00f1os, aumentando de 6.263 personas en 2000 a 23.141 en 2014. “La gran mayor\u00eda de las personas encarceladas son eslabones d\u00e9biles que viven situaciones de extrema vulnerabilidad. La c\u00e1rcel es una respuesta equivocada que agrava su situaci\u00f3n de vulnerabilidad. El 97% de los internos del pa\u00eds tienen m\u00e1ximo bachillerato completo y el 43% m\u00e1ximo primaria. Solo el 12% de las personas encarceladas por delitos cometieron conductas violentas” dijo Sergio Chaparro Hern\u00e1ndez, investigador de Dejusticia.<\/p>\n

En Brasil, el n\u00famero de personas encarceladas por delitos de drogas aument\u00f3 320% entre 2005 y 2012, en contraste a un aumento de 51% para la poblaci\u00f3n carcelaria en general.<\/p>\n

Seg\u00fan la investigaci\u00f3n, en M\u00e9xico, entre diciembre de 2006 y diciembre de 2014, la poblaci\u00f3n penitenciaria recluida en centros penitenciarios federales por delitos contra la salud aument\u00f3 en 1.200%. A la vez, el 60% de las personas recluidas en los centros de readaptaci\u00f3n social de nueve entidades federativas, est\u00e1n recluidas por delitos relacionados con el cannabis.<\/p>\n

Los informes ser\u00e1n lanzado en la C\u00e1mara de Diputados de M\u00e9xico junto con el Programa de Pol\u00edtica de Drogas del Centro de Investigaci\u00f3n y Docencia en Econ\u00f3micas (CIDE) en el foro Personas privadas de la libertad por drogas en Am\u00e9rica Latina: Los costos sociales de la pol\u00edtica de drogas. \u201cEn su conjunto los datos que se presentan muestran problemas como la feminizaci\u00f3n de los delitos de drogas, la criminalizaci\u00f3n y estigmatizaci\u00f3n de los j\u00f3venes por la pol\u00edtica de drogas y el importante costo social impl\u00edcito en el uso del derecho penal y el encarcelamiento para atender el problema de las drogas\u201d, dijo el diputado Mexicano Vidal Llerenas.<\/p>\n

Los informes tambi\u00e9n destacan un aumento preocupante de mujeres encarceladas por delitos de drogas. Seg\u00fan el estudio, en Argentina, el 65% de las mujeres encarceladas est\u00e1n en prisi\u00f3n por delitos de drogas. En Costa Rica y el Per\u00fa, los porcentajes son 75.46 y 60.6 respectivamente. La gran mayor\u00eda son madres solteras, j\u00f3venes y personas de bajos recursos, y frecuentemente pertenecen a minor\u00edas \u00e9tnicas.<\/p>\n

Si en Colombia se implementaran alternativas al encarcelamiento para las mujeres que han cometido delitos menores, no violentos, sin concurso con otros delitos, desparecer\u00eda el hacinamiento carcelario en c\u00e1rceles femeninas, que hoy es del orden del 45%<\/p>\n

\u201cLos informes presentan evidencias de que la poblaci\u00f3n encarcelada por drogas en el continente americano ha aumentado a un ritmo mayor que el resto de la poblaci\u00f3n penitenciaria\u201d, dijo Catalina P\u00e9rez Correa, Profesora del CIDE y coordinadora del proyecto, \u201cLas sentencias largas e injustas han tenido un efecto particularmente negativo en las mujeres, cuyo encarcelamiento viene creciendo, y refuerzan las condiciones de vulnerabilidad de sus hijas e hijos\u201d.<\/p>\n
