{"id":20820,"date":"2016-01-27T00:00:00","date_gmt":"2016-01-27T05:00:00","guid":{"rendered":"https:\/\/www.dejusticia.org\/what-should-judges-do-when-the-right-to-an-abortion-is-infringed\/"},"modified":"2017-02-16T17:53:49","modified_gmt":"2017-02-16T22:53:49","slug":"what-should-judges-do-when-the-right-to-an-abortion-is-infringed","status":"publish","type":"post","link":"https:\/\/develop.dejusticia.org\/en\/what-should-judges-do-when-the-right-to-an-abortion-is-infringed\/","title":{"rendered":"What Should Judges Do When the Right to an Abortion Is Infringed?"},"content":{"rendered":"<p>La investigaci\u00f3n que busca abordar un debate jur\u00eddico en el fondo trata de resolver el drama humano de qu\u00e9 hacer cuando las mujeres intentan acceder al aborto legal, pero se enfrentan a innumerables barreras que terminan limit\u00e1ndolo. &nbsp;<\/p>\n<p>Mediante la descripci\u00f3n de una serie de casos, las investigadoras intentan responder dos preguntas \u00bfcu\u00e1ndo exactamente se vulnera el derecho a al interrupci\u00f3n del embarazo? y \u00bfqu\u00e9 tipo de medidas deber\u00edan adoptar los jueces en los casos en que se vulnera este derecho?<\/p>\n<p>En realidad, ni la jurisprudencia de la Corte Constitucional colombiana ni los est\u00e1ndares internacionales han desarrollado las respuestas a estas preguntas centrales para lograr una garant\u00eda efectiva de los derechos de las mujeres.<\/p>\n<p>El libro entonces tambi\u00e9n incluye una propuesta en la que se resuelven estas preguntas planteadas que contribuye a fortalecer el contenido del derecho a la interrupci\u00f3n voluntaria del embarazo (IVE) y a abrir la puerta para la creaci\u00f3n de remedios judiciales por parte del juez constitucional en los casos en los que el derecho no es garantizado.
