Ahora que que estamos m\u00e1s cerca de que la ciudadan\u00eda pueda avalar o rechazar lo acordado en La Habana, la discusi\u00f3n p\u00fablica sobre el tema se polariza a\u00fan m\u00e1s. Los que se oponen a este acuerdo argumentan que la paz a cualquier costo no es deseable y que el acuerdo alcanzado en justicia no es suficiente porque permite un alto grado de impunidad. <\/span><\/p>\n

Una consigna frecuentemente enarbolada en redes sociales ha sido \u201cQueremos paz sin impunidad\u201d, implicando que el actual acuerdo no es justo o al menos no lo suficientemente justo. Pero \u00bfcu\u00e1nto de esto hay en realidad y hasta d\u00f3nde se ha vuelto esta consigna un lugar com\u00fan en la opini\u00f3n p\u00fablica?\u00a0 <\/span><\/p>\n

Lo cierto es hay que adentrarse en el dise\u00f1o espec\u00edfico de la Jurisdicci\u00f3n Especial para la Paz (JEP) para tener un punto de vista informado. A diferencia de lo que algunos dicen, en Dejusticia consideramos que el punto 5 de La Habana no es un acuerdo de impunidades.<\/p>\n

Esto hubiera sido as\u00ed si los negociadores de las Farc y el Gobierno hubieran pactado una amnist\u00eda general y sin condiciones para cr\u00edmenes de guerra y lesa humanidad, tal y como lo proscribe el derecho internacional de los derechos humanos.<\/p>\n

En realidad el acuerdo excluye de amnist\u00eda esos cr\u00edmenes y prev\u00e9 que los responsables deban enfrentarse ante una jurisdicci\u00f3n especial, compuesta por magistrados independientes, que investigue, sancione y aleje el manto de impunidad que hoy impera en el pa\u00eds sobre esos hechos.<\/p>\n

Los beneficios que se otorgar\u00e1n est\u00e1n condicionados a que exista colaboraci\u00f3n plena en t\u00e9rminos de verdad, justicia, reparaci\u00f3n y garant\u00edas de no repetici\u00f3n, tal y como lo ha establecido la Corte Constitucional en muchas de sus decisiones.<\/p>\n

El sistema dise\u00f1ado ha puesto condiciones para recibir esos beneficios al punto que quienes incumplan tendr\u00e1n prisi\u00f3n y no se les reconocer\u00e1 una pena alternativa. Por el contrario, quienes cumplan con todo tendr\u00e1n en todo caso una sanci\u00f3n significativa, que implica no s\u00f3lo la restricci\u00f3n efectiva de derechos y libertades sino que est\u00e1 acompa\u00f1ada de penas restaurativas y reparadoras, como el desminado.<\/p>\n

Adem\u00e1s est\u00e1n previstos otros mecanismos m\u00e1s amplios que la propia justicia para satisfacer los derechos de las v\u00edctimas, como la Comisi\u00f3n para el Esclarecimiento de la Verdad,\u00a0 <\/span>la Convivencia y la no Repetici\u00f3n y se fortalecer\u00e1n los programas masivos de reparaci\u00f3n con los que hoy cuenta el Estado, al igual que los mecanismos para encontrar a las personas desaparecidas.<\/p>\n

Los perpetradores de los cr\u00edmenes m\u00e1s graves, incluyendo cr\u00edmenes de lesa humanidad, como la violencia sexual, estar\u00e1n bajo la jurisdicci\u00f3n del Tribunal para la Paz de la JEP, y estar\u00e1n sujetos a entre 5 y 8 a\u00f1os de restricci\u00f3n efectiva de la libertad, siempre y cuando reconozcan su responsabilidad de manera temprana, participen activamente en el proceso, y mantengan su compromiso a la reparaci\u00f3n de las v\u00edctimas, entre otras obligaciones.<\/p>\n

Quienes no reconozcan su responsabilidad por sus cr\u00edmenes durante el proceso ante la JEP se enfrentar\u00e1n a penas graduadas cada vez mayores, entre las que se incluye una pena de hasta 20 a\u00f1os de prisi\u00f3n.<\/p>\n
