Un fallo de la Corte Constitucional le permitir\u00e1 a los municipios decidir sobre el uso del suelo.<\/p>\n

Los habitantes de la tranquila localidad de Pijao, en Quind\u00edo, tuvieron una semana agitada. La noticia de que su municipio estaba en la primera plana de los medios de comunicaci\u00f3n del pa\u00eds rompi\u00f3 su cotidianidad. Todo por una acci\u00f3n de tutela que interpuso una l\u00edder del municipio, que buscaba convocar a una consulta popular contra la miner\u00eda pero que logr\u00f3 lo inesperado: que la Corte Constitucional advirtiera que los entes territoriales s\u00ed puedan prohibir la miner\u00eda.<\/p>\n

Aunque la sentencia de la alta corte le cay\u00f3 como agua fr\u00eda al gremio minero que no entiende c\u00f3mo este fallo puede \u201clegislar sobre el sector (minero)\u201d, en el municipio celebran la decisi\u00f3n, pues aseguran que los 23 t\u00edtulos mineros que hay vigentes amenazan su vocaci\u00f3n agr\u00edcola.<\/p>\n

Estos t\u00edtulos fueron precisamente los que motivaron a la comunicadora social y exconcejal de Pijao, M\u00f3nica Fl\u00f3rez, a buscar los mecanismos que fueran necesarios para frenar la posible llegada de la locomotora minera al primer municipio \u2018slow\u2019 o sin prisa del Latinoam\u00e9rica.<\/p>\n

Tras varias actividades con la comunidad incluido un cabildo abierto, M\u00f3nica present\u00f3 la propuesta al alcalde anterior, Alberto Pe\u00f1a, quien radic\u00f3 en el Concejo Municipal un proyecto de acuerdo sobre la consulta popular y esta corporaci\u00f3n lo aprob\u00f3 por unanimidad.<\/p>\n

La iniciativa lleg\u00f3 al Tribunal Administrativo del Quind\u00edo que declar\u00f3 inconstitucional la pregunta \u201c\u00bfest\u00e1 usted de acuerdo, s\u00ed o no, con que en el municipio de Pijao se ejecuten actividades que impliquen contaminaci\u00f3n del suelo, p\u00e9rdida o contaminaci\u00f3n de fuentes h\u00eddricas, afectaci\u00f3n a la salubridad de la poblaci\u00f3n, o afectaci\u00f3n de la vocaci\u00f3n agropecuaria del municipio, con motivo de proyectos mineros?\u201d.<\/p>\n

Con el apoyo de la organizaci\u00f3n Dejusticia, la comunicadora formul\u00f3 una acci\u00f3n de tutela contra el Tribunal del Quind\u00edo que radic\u00f3 en el Consejo de Estado y que, en primera y segunda instancia, fue negada. \u201cSent\u00ed que el Tribunal nos hab\u00eda negado el derecho para que los ciudadanos de Pijao decidamos sobre el uso del suelo\u201d, dijo Fl\u00f3rez.<\/p>\n

Pero esto no se qued\u00f3 ah\u00ed, pues el caso pas\u00f3 a la Corte Constitucional, que esta semana revel\u00f3 su decisi\u00f3n: proteger el derecho de los habitantes de Pijao de expresar su opini\u00f3n a trav\u00e9s de las urnas frente a los impactos de la actividad minera en su territorio.<\/p>\n

\u201cPijao sienta un precedente en este tema, porque la Corte est\u00e1 diciendo finalmente que quienes deciden sobre miner\u00eda en los municipios son sus habitantes\u201d.<\/p>\n

Con estos t\u00edtulos mineros, Pijao se vio contra las cuerdas, pues vio amenazada su permanencia en la red mundial Cittaslow o ciudades sin prisa, objetivo que se consigui\u00f3 despu\u00e9s de 11 a\u00f1os y de la mano de Fl\u00f3rez, quien logr\u00f3 que Pijao fuera incluido en 2014 en esta red, que en ese momento ten\u00eda 221 pueblos de todo el mundo. Ella cuenta que fue su hermano, el concejal de Bogot\u00e1 Juan Carlos Fl\u00f3rez, quien le dio la idea de que Pijao podr\u00eda hacer parte de la red.<\/p>\n

Este grupo de ciudades sin prisa est\u00e1 conformado por localidades de menos de 50 mil habitantes que viven en comuni\u00f3n con la naturaleza, la cultura local y les brindan una buena calidad de vida.<\/p>\n

Los habitantes de este municipio, como la mayor\u00eda de los quindianos, como lo dijo el Gobernador del departamento, Carlos Osorio, rechazan la miner\u00eda. Incluso, en algunas de las coloridas viviendas, se aprecian letreros en contra de proyectos mineros.<\/p>\n

En 2012, se realiz\u00f3 all\u00ed una multitudinaria marcha en contra de la miner\u00eda. Pijao es el primero de los municipios del Quind\u00edo que llev\u00f3 al Tribunal Administrativo su intenci\u00f3n de realizar una consulta popular. Aunque los actuales alcaldes de C\u00f3rdoba y Salento han dicho que van a convocar a una consulta, a\u00fan no lo han hecho.<\/p>\n

Sin embargo, en el departamento hay optimismo tras la sentencia de la Corte, pues el Tribunal de Quind\u00edo no podr\u00e1 negar la posibilidad de una consulta popular con el argumento de que los entes territoriales no tienen el poder de tomar la decisi\u00f3n de regular el uso del suelo.<\/p>\n

Cabe recordar que, hace meses, la Corte tumb\u00f3 el art\u00edculo 37 de la Ley 685 del 2001, el C\u00f3digo Minero, que les imped\u00eda a alcaldes y concejos crear en sus municipios zonas vedadas para la miner\u00eda. Con este fallo, a trav\u00e9s de consultas populares y reformas de los Planes de Ordenamiento Territorial (POT), los entes locales podr\u00e1n frenar cualquier proyecto minero, una facultad que estaba en manos de las autoridades nacionales.<\/p>\n

El alcalde de Pijao, Edinson Aldana, se\u00f1al\u00f3 que quedaron las puertas abiertas y que \u201cla ciudadan\u00eda me presente la consulta. Es mi obligaci\u00f3n como alcalde prestar todas las herramientas necesarias para realizar la consulta\u201d.<\/p>\n

Por su parte el personero Albert Quintero tambi\u00e9n celebr\u00f3 la decisi\u00f3n, \u201ces muy importante para nosotros por la conservaci\u00f3n de los recursos naturales del municipio. Y se establece un precedente para que en los dem\u00e1s municipios puedan iniciar estos procesos\u201d.<\/p>\n
