La laguna costera m\u00e1s grande y productiva del pa\u00eds se est\u00e1 salinizando y est\u00e1 perdiendo el ox\u00edgeno, lo que ha provocado una crisis ambiental que lleva cuatro a\u00f1os agrav\u00e1ndose.<\/p>\n<p>Este ecosistema, declarado reserva de la biosfera y primer humedal Ramsar de Colombia (de importancia internacional), es la fuente de trabajo y alimentaci\u00f3n de unas 15.000 familias que habitan en los municipios de Sitionuevo, Puebloviejo, El Ret\u00e9n, Remolino y Salamina.<\/p>\n<p>Los pobladores de estos cinco pueblos 4.900 kil\u00f3metros cuadrados que conforman la Ci\u00e9naga Grande y cient\u00edficos de diferentes ramas, han advertido en reiteradas ocasiones sobre la gravedad de la problem\u00e1tica. Pero ni el Ministerio de Ambiente ni las autoridades ambientales han tomado decisiones contundentes y efectivas para frenar la crisis.<\/p>\n<p>Por esto, un grupo de pescadores de las comunidades palaf\u00edticas de Nueva Venecia y Buenavista (que pertenecen a Sitionuevo), decidieron tomar la v\u00eda judicial. En compa\u00f1\u00eda de Dejusticia y de la Universidad del Norte, presentaron una acci\u00f3n de tutela para reclamar la protecci\u00f3n de sus derechos al medio ambiente sano, a la vida digna, al m\u00ednimo vital, al trabajo y libertad de oficio, a la alimentaci\u00f3n y al agua.<\/p>\n<p>Los pescadores sostienen que los ministerios de Ambiente y Agricultura, Parques Nacionales Naturales, la Contralor\u00eda, la Procuradur\u00eda, la Fiscal\u00eda, la Gobernaci\u00f3n del Magdalena, CORPAMAG, las alcald\u00edas de los municipios afectados y tres contratistas privados, incumplieron \u201c<span lang=\"ES-TRAD\" style=\"font-size: 12.0pt; line-height: 107%; font-family: Arial; mso-fareast-font-family: Quattrocento; mso-ansi-language: ES-TRAD;\">las funciones que les corresponden\u201d para proteger este ecosistema. <\/span><\/p>\n<p>Los demandantes argumentan que la crisis actual responde a una suma de factores. Por un lado, a la presi\u00f3n de palmicultores, arroceros, bananeros y ganaderos, que se est\u00e1n quedando con el agua dulce que alimenta a la Ci\u00e9naga. Y por el otro, al precario mantenimiento y dragado de los ca\u00f1os que conectan a este ecosistema con el r\u00edo Magdalena. Adem\u00e1s, advierten que hay una nueva amenaza: el plan del Gobierno de construir dos grandes proyectos viales la doble calzada Ci\u00e9naga-Barranquilla y la V\u00eda de la Prosperidad), lo que afectar\u00edan el ciclo hidrol\u00f3gico de la laguna.<\/p>\n<p>Los pescadores est\u00e1n pidiendo que las autoridades presenten a corto plazo un plan para superar la crisis, que se realice el mantenimiento y dragado de los ca\u00f1os y que se estudie el uso de las tierras que rodean a la ci\u00e9naga.<\/p>\n<p>En una primera instancia, el Tribunal Superior de Santa Marta neg\u00f3 la acci\u00f3n de tutela \u201cpor improcedente\u201d. A pesar de que el juez reconoci\u00f3 que \u201cse evidencia un gran deterioro en la Ci\u00e9naga Grande de Santa Marta\u201d, sostuvo que el derecho colectivo al medio ambiente sano debe reclamarse a trav\u00e9s de una acci\u00f3n popular. Pero los pescadores no se rindieron. Presentaron una impugnaci\u00f3n a ese fallo, argumentando que la acci\u00f3n de tutela es oportuna cuando se busca proteger un derecho colectivo, cuya afectaci\u00f3n tambi\u00e9n lesiona un derecho fundamental.<\/p>\n<p>\u201cLa disminuci\u00f3n significativa y notoria de la pesca genera un impacto negativo directo en nuestros derechos fundamentales al trabajo, al m\u00ednimo vital, a la vida digna y a la alimentaci\u00f3n\u201d, se\u00f1alaron.
