El Estado colombiano pierde valiosos recursos a causa de condenas judiciales surgidas de conflictos contractuales y extra-contractuales. En muchas ocasiones, las condenas son el resultado de las justas reclamaciones de ciudadanos y empresas perjudicados por acciones u omisiones del Estado. En muchos casos, sin embargo, las condenas resultan de una deficiente estrategia de defensa judicial estatal. Por ello, el Estado central y administraciones locales como la de Bogot\u00e1 han emprendido en los \u00faltimos a\u00f1os programas de fortalecimiento de los sistemas de informaci\u00f3n y de litigio p\u00fablicos, que buscan afianzar una estrategia eficaz de defensa judicial. Este texto recoge los resultados de una investigaci\u00f3n sistem\u00e1tica de DJS que contribuye a esta tarea mediante el an\u00e1lisis de los nuevos programas estatales y el estudio emp\u00edrico de los litigios extra-contractuales y laborales que m\u00e1s condenas generan contra el Estado colombiano. The State of Colombia loses valuable resources because of damages awarded by courts in contract and tort cases. Many times, damage judgments result from citizens and companies hurt by the state\u2019s actions or omissions. Often, however, these judicial decisions are the result of the state\u2019s poor performance in court. Because of this, the central state and some cities, like Bogot\u00e1, have started programs in recent years to strengthen systems that monitor public information and trials involving the state, in order to develop more effective defense strategies in court. This document gathers the results of a thorough investigation by DJS that contributes to this effort by analyzing new state programs and by empirically studying tort and labor cases that most often result in damage judgments against the state. The text ends with specific recommendations on how to consolidate a new strategy for the judicial defense of the state.
