El art\u00edculo muestra las relaciones que pueden hacerse entre la pr\u00e1ctica de la interpretaci\u00f3n constitucional y los problemas de la fundamentaci\u00f3n de la universalidad de los derechos humanos. Para ello el art\u00edculo hace un estudio sistem\u00e1tico de la forma como la jurisprudencia constitucional colombiana, alemana y estadounidense han resuelto las tensiones entre el derecho a la intimidad y la liberad de informaci\u00f3n, y muestra que a las distintas formas de soluci\u00f3n de esas tensiones corresponden distintos conceptos de democracia constitucional. Y sostiene que la armonizaci\u00f3n pr\u00e1ctica de esas tensiones constitucionales es una muestra de que es posible alcanzar, por medio del di\u00e1logo y de la ponderaci\u00f3n, una cierta universalidad de los derechos humanos, que sea respetuosa de la diversidad de perspectivas para entenderlos. The article shows the relationship between the practice of the constitutional interpretation and the problems of the fundamentalism of universality of human rights. The article does a systematic study of Colombian, German, and American constitutional jurisprudence that has resolved the tensions between the right to privacy and the right to freedom of information. It also samples different solutions to the tensions of constitutional democracy.
