En las \u00faltimas semanas, personajes acad\u00e9micos y pol\u00edticos se han manifestado en relaci\u00f3n con la terna presentada por la Corte Suprema de Justicia para que el Senado escoja el reemplazo del magistrado Alfredo Beltr\u00e1n Sierra. La terna ha sido criticada desde dos \u00e1ngulos: el de la ausencia de mujeres y el del sesgo anti-tutela de sus miembros. En nuestra opini\u00f3n, en la discusi\u00f3n alrededor de las calidades de los candidatos se deber\u00edan tener en cuenta, adem\u00e1s de estos, otros temas que hasta ahora no han sido suficientemente explicitados. <\/p>\n

La ausencia de mujeres en la terna es ciertamente preocupante al menos por dos razones. La primera es que no existe un fundamento f\u00e1ctico para argumentar la ausencia de mujeres con suficientes cualidades para ocupar el cargo del que se trata. La segunda es que la ley de cuotas exige la presencia de mujeres en todas las ternas cuando ellas son conformadas por una sola instituci\u00f3n. <\/p>\n

Las altas cortes colombianas no se caracterizan exactamente por haber hecho esfuerzos significativos para incluir un n\u00famero equitativo de mujeres como magistrados. En la actualidad, s\u00f3lo hay una mujer en la Corte Constitucional (compuesta por nueve magistrados), dos mujeres en la Corte Suprema de Justicia (compuesta por 25 magistrados) y siete mujeres en el Consejo de Estado (compuesto por 29 magistrados). Esto, a pesar de que las mujeres desde hace m\u00e1s de 30 a\u00f1os constituyen m\u00e1s de la mitad de los egresados de las facultades de derecho del pa\u00eds. <\/p>\n","protected":false},"excerpt":{"rendered":"
