{"id":25533,"date":"2005-12-30T00:00:00","date_gmt":"2005-12-30T05:00:00","guid":{"rendered":"https:\/\/www.dejusticia.org\/control-over-judicial-rulings\/"},"modified":"2017-04-11T07:19:52","modified_gmt":"2017-04-11T12:19:52","slug":"control-over-judicial-rulings","status":"publish","type":"post","link":"https:\/\/develop.dejusticia.org\/en\/control-over-judicial-rulings\/","title":{"rendered":"Control over Judicial Rulings"},"content":{"rendered":"<p>\t El 19 de marzo de 2002 la Corte Suprema de Justicia1, declar\u00f3 p\u00fablicamente su intenci\u00f3n de inaplicar los fallos de tutela proferidos por otras corporaciones judiciales, que ordenaran anular o modificar las providencias que dicha Corte hubiere emitido como m\u00e1ximo tribunal de la jurisdicci\u00f3n ordinaria. En palabras del presidente de la Corporaci\u00f3n, la acci\u00f3n de tutela no procede contra providencias proferidas con ocasi\u00f3n del tr\u00e1mite de casaci\u00f3n. En su criterio, tal decisi\u00f3n busca \u00abdefender la seguridad jur\u00eddica del pa\u00eds, la cosa juzgada y el respeto al orden y a la estructura se\u00f1alados en la Carta Fundamental de los colombianos&#8221;.<\/p>\n<p>A juicio de la Corte, en la medida en que la Constituci\u00f3n le confiere el<br \/>\ncar\u00e1cter de m\u00e1ximo tribunal de la jurisdicci\u00f3n ordinaria, ser\u00eda inconstitucional que otros jueces de inferior jerarqu\u00eda o de otras jurisdicciones pudieran revisar, anular o corregir sus decisiones pues, en este caso, dejar\u00eda de ser el \u00f3rgano de cierre de la respectiva jurisdicci\u00f3n. Por lo tanto, para mantener el car\u00e1cter que la Constituci\u00f3n le ha asignado, la acci\u00f3n de tutela no puede proceder contra sus providencias cuando quiera que estas sean el resultado de un proceso en el cual la Corte act\u00fae como tribunal de casaci\u00f3n, es decir, como m\u00e1ximo \u00f3rgano de la jurisdicci\u00f3n ordinaria. Cosa distinta, contin\u00faa la Corte, es la revisi\u00f3n de las sentencias de tutela proferidas por esta Corporaci\u00f3n. En tales casos, la Corte Constitucional tiene la \u00faltima palabra como tribunal supremo de la jurisdicci\u00f3n constitucional.<br \/>\nEl argumento anterior se suma a otros que se han ventilado en distintos<br \/>\nforos de discusi\u00f3n sobre la acci\u00f3n de tutela desde que la Corte Constitucional<br \/>\nacept\u00f3, por vez primera, que dicha acci\u00f3n pod\u00eda proceder contra decisiones de las altas cortes. Para quienes se oponen a esta tesis, resulta inconstitucional, inconveniente y a todas luces incompatible con los principios m\u00ednimos de un \u00aborden justo\u00bb la procedencia de la acci\u00f3n de tutela contra sentencias. En suma, sostienen que la procedencia de la acci\u00f3n de tutela contra providencias judiciales vulnera el principio de la cosa juzgada, la seguridad jur\u00eddica, la autonom\u00eda funcional del juez, la estructura constitucional del poder judicial y, finalmente, desvirt\u00faa la naturaleza de la acci\u00f3n de tutela.<br \/>\nApelando a estos argumentos, el proyecto de acto legislativo de reforma a la<br \/>\njusticia presentado por el Gobierno al Congreso en los primeros d\u00edas de noviembre, propone reformar el art\u00edculo 86 de la Constituci\u00f3n, entre otras cosas suprimiendo radicalmente la procedencia de la acci\u00f3n de tutela contra decisiones judiciales.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>\t In Colombia, there is a vigorous debate on the constitutional control of court rulings.
