Con esta decisi\u00f3n se impone la l\u00f3gica de un constitucionalismo intermitente, en el que la Constituci\u00f3n solo se aplica a voluntad del gobierno. <\/p>\n<p>No estar\u00edamos padeciendo esta esquizofrenia si la Corte Constitucional hubiese puesto de presente que los efectos de su sentencia sobre la Ley de Justicia y Paz eran retroactivos.<\/p>\n<p>La Constituci\u00f3n intermitente<\/p>\n<p>En la sentencia sobre la Ley de Justicia y Paz, la Corte Constitucional tom\u00f3 decisiones esperanzadoras que corrigen los desafueros de la Ley y hacen valer la constituci\u00f3n pol\u00edtica. Pero tambi\u00e9n dijo que su decisi\u00f3n s\u00f3lo tiene efectos hacia el futuro, con lo cual, seg\u00fan el Gobierno, se siembran dudas sobre la aplicaci\u00f3n de la sentencia en el actual proceso de paz.<\/p>\n<p>Ya conocemos el proyecto de decreto reglamentario de la Ley que intenta resolver esas dudas y, por esa v\u00eda, impedir que la sentencia de la Corte se aplique. Cuando uno lee esa sentencia y luego lee el proyecto de decreto reglamentario tiene la sensaci\u00f3n de vivir en dos pa\u00edses distintos.<\/p>\n<p>No estar\u00edamos padeciendo esta esquizofrenia si la Corte hubiese puesto de presente que los efectos de su sentencia eran retroactivos. Desafortunadamente no lo hizo: \u00bfpor error?, \u00bfpor quedar bien con todo el mundo? No lo s\u00e9, pero concluir a partir de esa omisi\u00f3n que su sentencia no se aplica en el actual proceso de paz es tanto como creer que tenemos una constituci\u00f3n intermitente que se apaga y se prende al antojo de la voluntad gubernamental.<\/p>\n<p>En este tema de los efectos de las sentencias constitucionales se mezclan una discusi\u00f3n jur\u00eddica importante y una pr\u00e1ctica gubernamental deplorable. Explico lo primero.<\/p>\n<p>Hay normas que son contrarias a la Constituci\u00f3n. Pero para eso est\u00e1 la Corte, para declararlas inconstitucionales. Ahora bien, \u00bfqu\u00e9 pasa con los efectos que las leyes producen antes de ser declaradas inconstitucionales? Seg\u00fan la tradici\u00f3n jur\u00eddica colombiana, los efectos que produjeron no se pueden deshacer. La sentencia de inconstitucionalidad solo vale para el futuro. La soluci\u00f3n opuesta -que existe en Alemania, Portugal o Espa\u00f1a- sostiene que la decisi\u00f3n tiene efectos retroactivos, es decir, que nada de lo que se produjo es v\u00e1lido.<\/p>\n<p>Con la constituci\u00f3n de 1991 la Corte adopt\u00f3 una posici\u00f3n intermedia y de esa manera modific\u00f3 la tradici\u00f3n jur\u00eddica que prevalec\u00eda durante la constituci\u00f3n de 1886. Para evitar situaciones injustas, dijo la Corte, en algunos casos se puede establecer que la sentencia tiene efectos retroactivos. Uno de esos casos es, por ejemplo, el cobro de un impuesto a trav\u00e9s de una ley inconstitucional. En este caso, la Corte ordena que su decisi\u00f3n tenga efectos retroactivos y que se devuelva el dinero a quienes pagaron cumplidamente.<\/p>\n<p>Hasta aqu\u00ed el debate parece simplemente jur\u00eddico y t\u00e9cnico. Pero detr\u00e1s se esconde una deplorable pr\u00e1ctica institucional. En Colombia los gobiernos dise\u00f1an sus pol\u00edticas de orden p\u00fablico -que en un pa\u00eds en guerra son lo esencial de la pol\u00edtica- a partir de normas que, con mucha frecuencia, son inconstitucionales. En principio, eso no es tan grave pues la Corte controla lo que el Gobierno expide. Sin embargo, en la pr\u00e1ctica, la declaraci\u00f3n posterior de inconstitucionalidad no suele afectar dichas pol\u00edticas por una raz\u00f3n simple: ella sucede cinco o seis meses despu\u00e9s de promulgada la ley contraria a la Constituci\u00f3n. Para ese entonces, el Gobierno tiene dise\u00f1ado otro decreto-ley -que tambi\u00e9n suele ser inconstitucional- que regir\u00e1 por los cinco o seis meses siguientes, y as\u00ed sucesivamente.<\/p>\n<p>En medio de esta producci\u00f3n fren\u00e9tica de normas, las decisiones de la Corte salvan el honor del derecho, pero solo ante la academia y los foros internacionales. Los decretos del Gobierno, por su lado, terminan siendo el alma viva de un ordenamiento jur\u00eddico fundado m\u00e1s en la voluntad presidencial que en la norma constitucional.<\/p>\n<p>Con el proyecto de decreto reglamentario de la Ley de Justicia y Paz, el Gobierno quiere imponer la idea de que la sentencia de la Corte no se aplica a los paramilitares desmovilizados, sino a quienes se acojan a otros procesos de paz en el futuro.<\/p>\n<p>Con la l\u00f3gica de este constitucionalismo intermitente, el Gobierno podr\u00eda hacer infinidad de procesos de paz fundados en leyes inconstitucionales&#8230; y seguir elogiando las leyes de nuestra patria.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>With a plan of a regulation degree by the Law of Justice and Peace, the Government wants to impose the idea that the sentence of the Court does not apply to demobilized paramilitary.
