La acci\u00f3n de tutela es considerada como la innovaci\u00f3n m\u00e1s importante introducida por la Constituci\u00f3n de 1991. Las cifras acerca de su uso dan cuenta de c\u00f3mo los colombianos la han incorporado dentro de sus relaciones con la administraci\u00f3n p\u00fablica y con particulares ante los que se encuentran en una posici\u00f3n de subordinaci\u00f3n o indefensi\u00f3n. Hasta el 31 de diciembre de 2005 se hab\u00edan instaurado en el pa\u00eds 1.262.346 acciones de tutela. Precisamente, el amplio uso de la acci\u00f3n permite afirmar que la tutela ha generado toda una revoluci\u00f3n jur\u00eddica, en la medida en que a trav\u00e9s de ella se han ido constitucionalizando todos los espacios de la vida social y pol\u00edtica del pa\u00eds. En realidad, casi no hay temas relacionados con la convivencia social sobre los cuales no se haya solicitado la intervenci\u00f3n judicial a trav\u00e9s de la tutela. En la pr\u00e1ctica esto ha significado tanto que los distintos espacios sociales reciban exigencias para que se adapten a los principios y los derechos contemplados en la Constituci\u00f3n, como que los jueces hayan adquirido un papel principal en el ordenamiento de la vida social y pol\u00edtica. Sin embargo, alrededor de la acci\u00f3n de tutela tambi\u00e9n se han generado distintos conflictos. Dentro de la Rama Judicial, estas disputas se han concentrado fundamentalmente en la obligaci\u00f3n de la Corte Suprema de Justicia y del Consejo de Estado de conocer sobre las acciones de tutela y en la existencia de la tutela contra providencias judiciales. Este art\u00edculo trata sobre el conflicto existente entre las altas cortes en torno a la tutela contra sentencias, conocido como el ?choque de trenes?. Este litigio surgi\u00f3 desde el primer momento de actuaci\u00f3n de la Corte Constitucional y reaparece cada cierto tiempo en los debates p\u00fablicos del pa\u00eds, en ocasiones con mucha rudeza.<\/p>\n","protected":false},"excerpt":{"rendered":"
