Tanto en la discusi\u00f3n del TLC en el Congreso Nacional como en su eventual revisi\u00f3n por la Corte Constitucional, una de las preguntas fundamentales es si el tratado se ajusta a la Constituci\u00f3n nacional. En el caso del tr\u00e1mite actual ante el Congreso, en virtud de la supremac\u00eda jur\u00eddica de la Constituci\u00f3n, el legislativo, adem\u00e1s de ejercer un control pol\u00edtico del TLC, tiene la facultad y la obligaci\u00f3n de estudiar la constitucionalidad de las normas contenidas en el tratado para evitar incorporar al derecho nacional normas contrarias a la Carta.<\/p>\n

Aunque la mayor parte del TLC es constitucional, existen normas importantes que merecen especial atenci\u00f3n por parte del Congreso y la Corte Constitucional por presentar vicios potenciales de inconstitucionalidad. En este documento se explica el control constitucional del TLC y se analizan cuatro cl\u00e1usulas relacionadas con propiedad intelectual, soluci\u00f3n de controversias, expropiaciones indirectas y reclamaciones sin infracci\u00f3n, que pueden vulnerar las normas constitucionales sobre el derecho a la salud, el principio de igualdad y la capacidad regulatoria y jurisdiccional del Estado. En cada caso, se sugieren ajustes para que el Congreso, a trav\u00e9s de reservas o declaraciones interpretativas, las excluya o las interprete de tal forma que el TLC se ci\u00f1a a la Constituci\u00f3n. <\/p>\n
