{"id":25829,"date":"2008-01-05T00:00:00","date_gmt":"2008-01-05T05:00:00","guid":{"rendered":"https:\/\/www.dejusticia.org\/2008-the-year-of-local-public-politics\/"},"modified":"2017-04-11T07:23:52","modified_gmt":"2017-04-11T12:23:52","slug":"2008-the-year-of-local-public-politics","status":"publish","type":"post","link":"https:\/\/develop.dejusticia.org\/en\/2008-the-year-of-local-public-politics\/","title":{"rendered":"2008: the year of local public politics"},"content":{"rendered":"<p>Bien mirado, el plan local de desarrollo constituye el indicador m\u00e1s tangible de lo que es una pol\u00edtica p\u00fablica municipal, distrital o departamental. Basta constatar que la oferta institucional ?v.g. en materia de salud, educaci\u00f3n, vivienda, recreaci\u00f3n, deporte, cultura, etc- que realmente se piense ejecutar durante el periodo de gobierno respectivo, debe convertirse en programas y proyectos concretos debidamente financiados. Lo dem\u00e1s es pura demagogia. <\/p>\n<p>Como es sabido, el dise\u00f1o y consolidaci\u00f3n de los planes de desarrollo corre por cuenta de los gobernantes elegidos, a partir de los lineamientos planteados por los candidatos ganadores en sus respectivos programas de gobierno. A la postre, el plan local de desarrollo adquiere la forma jur\u00eddica de acuerdo, ordenanza o decreto, seg\u00fan que el mismo sea aprobado por el concejo, la asamblea o el gobernante correspondiente. <\/p>\n<p>El car\u00e1cter normativo del plan local de desarrollo le imprime obligatoriedad, lo que conlleva al menos dos consecuencias: de un lado, impone al gobernante la necesidad de hacer una oferta institucional razonable, que atienda la demanda de derechos ciudadanos, las prioridades establecidas en el programa de gobierno, el tiempo de ejecuci\u00f3n y los recursos disponibles; y de otro, facilita a la ciudadan\u00eda en general hacer exigibles sus derechos. No sobra insistir en que un plan de desarrollo que tome en consideraci\u00f3n al menos las dos consecuencias se\u00f1aladas, facilitada su ejecuci\u00f3n y de paso, la acci\u00f3n pol\u00edtica del gobernante se ver\u00e1 legitimada. <\/p>\n<p>La clave entonces est\u00e1 en hacer del plan de desarrollo no solo un ejercicio t\u00e9cnico, sino una oportunidad para hacer efectivo el derecho a la participaci\u00f3n ciudadana en la toma de decisiones que los involucran. En parte por desconocimiento, en parte por inercia institucional, en parte por arrogancia, en parte por testarudez, los gobernantes locales siguen validando la p\u00e9sima pr\u00e1ctica ?que debe erradicarse a toda costa- de pagar un experto en planeaci\u00f3n y pol\u00edticas p\u00fablicas para que realice el proyecto de plan, lo cual no resulta muy dif\u00edcil a partir de la informaci\u00f3n existente en los planes anteriores y la que se encuentra disponible en la p\u00e1gina web sobre municipios colombianos y planeaci\u00f3n nacional. <\/p>\n<p>El experto sin duda hace falta para orientar el plan en su parte m\u00e1s t\u00e9cnica. Pero lo sustantivo del mismo debe provenir del trabajo que realice el nuevo equipo de gobierno destacado para el efecto, bajo la orientaci\u00f3n del gobernante, y particularmente, de los aportes que realice la ciudadan\u00eda congregada en torno a los consejos territoriales de planeaci\u00f3n ?municipal, distrital o departamental-. <\/p>\n<p>El consejo de planeaci\u00f3n es uno de los poqu\u00edsimos organismos de su tipo que tiene rango constitucional, entronizado en el 91, desarrollado legalmente en el 94 y llamado a constituirse en el m\u00e1s importante espacio de participaci\u00f3n en materia de pol\u00edticas p\u00fablicas. All\u00ed pueden acudir, seg\u00fan permisi\u00f3n legal, los m\u00e1s variados sectores de la poblaci\u00f3n ?econ\u00f3mico, ecol\u00f3gico, social, educativo, cultural, comunitario, ind\u00edgenas, afrodescendientes y mujeres- y cumplen, entre otras funciones, un rol consultivo muy importante en el momento del dise\u00f1o y aprobaci\u00f3n de los planes de desarrollo. <\/p>\n<p>Muchos alcaldes y gobernadores creen tener asegurado el tr\u00e1mite del plan de desarrollo si cuentan con un experto en planeaci\u00f3n, pero olvidan o quieren olvidar que la parte sustantiva del mismo, con r\u00e9ditos democr\u00e1ticos y de gobernabilidad, radica en la efectiva participaci\u00f3n de la comunidad que piensan orientar los pr\u00f3ximos cuatro a\u00f1os. <\/p>\n<p>Debe asegurarse entonces, por parte del gobernante local, el funcionamiento real de esos espacios de participaci\u00f3n por antonomasia que son los consejos territoriales de planeaci\u00f3n. Por su parte, la ciudadan\u00eda debe aprovechar la potencialidad de tales espacios institucionales, pues se trata de una ruta id\u00f3nea no solo para la reivindicaci\u00f3n de derechos, sino para el ejercicio efectivo de un control ciudadano de la pol\u00edtica p\u00fablica. <\/p>\n<p>&#8220;El Centro de Estudios de Derecho, Justicia y Sociedad -DeJuSticia-(www.dejusticia.org) fue creado en 2003 por un grupo de profesores universitarios, con el fin de contribuir a debates sobre el derecho, las instituciones y las pol\u00edticas p\u00fablicas, con base en estudios rigurosos que promuevan la formaci\u00f3n de una ciudadan\u00eda sin exclusiones y la vigencia de la democracia, el Estado social de derecho y los derechos humanos.&#8221; <\/p>\n","protected":false},"excerpt":{"rendered":"<p>The first thing that the next 1096 mayors and 32 governors should do starting January 1, 2008 is to coordinate the elaboration of their respective local plans of development as well as a sort of comprehensive four year plan.
