En los \u00faltimos a\u00f1os, en Colombia se ha empezado a usar de manera creciente la expresi\u00f3n y el enfoque de la llamada \u201cjusticia transicional\u201d, en especial para discutir el posible marco normativo del proceso de desmovilizaci\u00f3n de los grupos paramilitares. Esta situaci\u00f3n no deja de ser parad\u00f3jica pues, aunque no existe una definici\u00f3n de justicia transicional un\u00e1nimemente aceptada por los estudiosos, es claro que \u00e9sta hace al menos referencia a la siguiente idea: que las transiciones de la guerra a la paz o de las dictaduras a las democracias deben respetar unos est\u00e1ndares m\u00ednimos de justicia, que est\u00e1n vinculados a los derechos de las v\u00edctimas de los cr\u00edmenes atroces. Por consiguiente, para hablar de justicia transicional, parecer\u00eda necesario que al menos Colombia estuviera viviendo realmente una transici\u00f3n, esto es una superaci\u00f3n del conflicto armado. Pero, como lo veremos, eso dista de ser as\u00ed, pues en el mejor de los casos, la desmovilizaci\u00f3n de los grupos paramilitares ser\u00eda una transici\u00f3n \u00fanicamente parcial, pues no involucrar\u00eda a todos los actores armados ilegales. <\/p>\n","protected":false},"excerpt":{"rendered":"

Although the term has yet to be clearly defined, the concept of \u201ctransitional justice\u201d has become increasingly popular in recent years. Using the case study of the peace negotiations between the Colombian government and paramilitary groups, the authors explore the implications and limitations of the rhetoric of transitional justice. The study focuses on the relations of politics, law and the protection of human rights in times of significant national transition.
