LA PObreza es sin duda el m\u00e1s com\u00fan y extendido de todos ellos. Pero muchos pa\u00edses enfrentan dificultades propias: en Bangladesh luchan contra una naturaleza inclemente; en Georgia tratan de contener el imperialismo ruso; en B\u00e9lgica hacen lo posible por evitar la desmembraci\u00f3n del pa\u00eds; en Ucrania combaten el envejecimiento de la poblaci\u00f3n, etc. \u00bfY en Colombia? Pues aqu\u00ed no falta la pobreza \u2014la padece el 60% de la poblaci\u00f3n\u2014 y como si eso fuera poco, tenemos problemas t\u00edpicamente nuestros y \u00e9stos no son de poca monta: narcotr\u00e1fico, violencia y conflicto armado.<br \/>\nPara enfrentar esos males, cada pa\u00eds adopta un tipo especial de pol\u00edtica p\u00fablica o fortalece un tipo particular de instituci\u00f3n. En Colombia uno esperar\u00eda que, dados esos problemas, los gobiernos estuvieran empe\u00f1ados en hacer tres cosas: 1) fortalecer los derechos sociales de la gente, 2) crear una fuerza p\u00fablica m\u00e1s eficiente y 3) mejorar el desempe\u00f1o de la justicia. Pero de esos tres prop\u00f3sitos s\u00f3lo uno se toma realmente en serio, el de la fuerza p\u00fablica. Los otros dos, no s\u00f3lo no obtienen ninguna mejor\u00eda, sino que se empeoran.<\/p>\n<p>Una prueba fehaciente del menosprecio que el Gobierno siente por la justicia es la declaraci\u00f3n de la conmoci\u00f3n interior que \u2014siguiendo la recomendaci\u00f3n hecha por el banquero Luis Carlos Sarmiento\u2014 acaba de ser decretada para detener el paro de los jueces. Se trata de una medida a todas luces desproporcionada, que pone a los jueces como delincuentes o, peor a\u00fan, como los causantes de una \u201cgrave perturbaci\u00f3n del orden p\u00fablico que atenta de manera inminente contra la estabilidad institucional\u2026\u201d, seg\u00fan dice el art\u00edculo constitucional que consagra la conmoci\u00f3n.<\/p>\n<p>Pero el menosprecio por la justicia tiene ya una larga historia en este Gobierno. Ella  empez\u00f3 cuando el Presidente, a los pocos d\u00edas de posesionado, suprimi\u00f3 el Ministerio de Justicia. All\u00ed se dijo todo acerca del poco valor que los jueces representaban para la pol\u00edtica de seguridad democr\u00e1tica. Luego vino una serie de desplantes e insultos contra las altas cortes. Primero contra la Corte Constitucional, cuando neg\u00f3 la pr\u00f3rroga de la primera conmoci\u00f3n interior, se opuso al Estatuto Antiterrorista y limit\u00f3 dr\u00e1sticamente la Ley de Justicia y Paz; luego contra la Corte Suprema de Justicia cuando inici\u00f3 los procesos contra los congresistas de la coalici\u00f3n de Gobierno por parapol\u00edtica.<\/p>\n<p>Otra muestra reciente del menosprecio presidencial por los jueces est\u00e1 en el proyecto de Acto Legislativo 07 de 2008, supuestamente destinado a reformar la justicia, pero en realidad concebido, a mi juicio, para reorganizar a las altas cortes y para cambiar la forma de juzgar a los congresistas en la Corte Suprema. En ese proyecto no se trata de resolver los graves problemas que tiene la justicia \u2014congesti\u00f3n, impunidad, incapacidad para investigar, oferta inadecuada, sesgo en contra de los pobres, etc.\u2014 sino de enfrentar los procesos de la parapol\u00edtica y reequilibrar el nombramiento de los altos funcionarios, todo ello con el fin de llevar a buen t\u00e9rmino la nueva reelecci\u00f3n.<\/p>\n<p>Ahora que escribo el final de esta columna me doy cuenta de que en Colombia no tenemos que resolver tres, sino cuatro problemas: me falt\u00f3 el del deterioro institucional y la p\u00e9rdida de controles al interior del Estado como consecuencia del autoritarismo presidencial.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Every country has its evils.
