La raz\u00f3n: las comunidades ind\u00edgenas y afrodescendientes nunca fueron consultadas por el Ejecutivo durante el tr\u00e1mite de la norma en el Congreso.<\/p>\n<p>Con esta tesis, defendida hasta el viernes pasado por el magistrado de la Corte Constitucional Jaime C\u00f3rdoba \u2014quien sali\u00f3 de la corporaci\u00f3n junto con tres magistrados m\u00e1s por per\u00edodo cumplido\u2014, el jurista pidi\u00f3 que se declarara la inconstitucionalidad del Estatuto de Desarrollo Rural. Su ponencia recoge los conceptos del departamento de Derecho de la Universidad del Rosario, el Centro de Estudios de Derecho DeJusticia, la Organizaci\u00f3n Nacional Ind\u00edgena (ONIC), la Comisi\u00f3n Colombiana de Juristas, entre otros, que coinciden en que la ley desconoci\u00f3 abiertamente el derecho de consulta a las comunidades afrodescendientes e ind\u00edgenas en asuntos que las afectaban de manera directa.<\/p>\n<p>La ponencia del magistrado C\u00f3rdoba dej\u00f3 consignado que se viol\u00f3 el Convenio 169 de la Organizaci\u00f3n Internacional del Trabajo (OIT) que reza que, previo a cualquier acto legislativo que afecte comunidades ind\u00edgenas o \u2018afros\u2019, \u00e9stas deben ser enteradas y consultadas. En este caso respecto al uso y derechos que tienen sobre sus territorios y las disposiciones del Estatuto de Desarrollo Rural que afectan el destino que se les pueda dar a esos lugares para la explotaci\u00f3n econ\u00f3mica de particulares. De acuerdo con la tesis de C\u00f3rdoba, se intent\u00f3 una consulta con las comunidades cuando la ley estaba pr\u00e1cticamente \u2018cocinada\u2019, lo cual es un vicio de inconstitucionalidad.<\/p>\n<p>La semana pasada los magistrados de la Corte se enfrascaron en un \u00e1lgido debate en torno a la ponencia de Jaime C\u00f3rdoba. Los detalles de la candente sesi\u00f3n fueron conocidos por El Espectador. A favor de que se tumbara el Estatuto de Desarrollo Rural se mostraron los magistrados Jaime Ara\u00fajo Renter\u00eda, Clara In\u00e9s Vargas y Clara Elena Reales. En contra votaron Marco Gerardo Monroy, Humberto Sierra, Nilson Pinilla y Gabriel Mendoza. El magistrado Mauricio Gonz\u00e1lez se declar\u00f3 impedido por haber promovido la norma cuando fue secretario jur\u00eddico de Palacio. <\/p>\n<p>Al no existir mayor\u00eda, la Corte dej\u00f3 para esta semana el estudio nuevamente del pol\u00e9mico Estatuto de Desarrollo Rural y nombr\u00f3 como conjuez al abogado Rodolfo Arango. Con una particularidad: la votaci\u00f3n podr\u00eda cambiar radicalmente ya que los magistrados Ara\u00fajo, C\u00f3rdoba, Monroy y Vargas salieron de la corporaci\u00f3n el viernes pasado y fueron reemplazados por Juan Carlos Henao, Luis Ernesto Vargas y Jorge Iv\u00e1n Palacio.
