En ocasiones es un destello de c\u00f3lera, por ejemplo cuando ataca a sus enemigos o simplemente descalifica a quienes no opinan como \u00e9l.<\/p>\n<p>En otras ocasiones es un estilo abusivo de gobierno. Un ejemplo de esto \u00faltimo puede verse en la manera como el Presidente elabora ternas para nombrar altos funcionarios del Estado. La reci\u00e9n devuelta terna para nombrar fiscal es uno de esos casos.<\/p>\n<p>La Constituci\u00f3n faculta al presidente para elaborar algunas ternas. Pero eso no significa que esa facultad no tenga l\u00edmites. No es lo mismo nombrar a un ministro, que hacer la terna para nombrar a un magistrado o a un Fiscal. El presidente tiene plena discrecionalidad para nombrar y destituir a sus funcionarios de libre nombramiento y remoci\u00f3n. Pero cuando se trata de los funcionarios de los organismos de control, el presidente ejerce funciones que afectan al Estado y eso hace que sus poderes est\u00e9n limitados por la obligaci\u00f3n constitucional de mantener el equilibrio institucional.<\/p>\n<p>Muchas de las ternas elaboradas por el Presidente han sido \u201cternas de uno\u201d y prueba de ello son las votaciones abrumadoras que sistem\u00e1ticamente obtuvieron  los ganadores. As\u00ed por ejemplo, en las trece ternas presidenciales que pasaron por el Congreso (magistrados, Defensor, etc.) los elegidos obtuvieron, en promedio, el 80% de la votaci\u00f3n. En ocho de los trece casos los nombramientos superaron el 75%, en cuatro el 90% y en dos el 95%.<\/p>\n<p>Otras veces lo que pasa es que el Presidente escoge al comod\u00edn. As\u00ed sucedi\u00f3 con la elecci\u00f3n del procurador Ord\u00f3\u00f1ez, quien fue postulado por el Consejo de Estado, pero era de los afectos del Presidente. Pues bien, Uribe propuso a una persona que no ten\u00eda las m\u00e1s m\u00ednimas posibilidades de ganar y fue as\u00ed como Alejandro Ord\u00f3\u00f1ez result\u00f3 elegido con el 95% de los votos. Por Germ\u00e1n Bustillo, el candidato presidencial, nadie vot\u00f3.<\/p>\n<p>En otras ocasiones el Presidente parece delegar la elaboraci\u00f3n de la terna en un partido de la coalici\u00f3n de Gobierno. Todo indica que las ternas que se utilizaron para elegir al Defensor y al Fiscal fueron hechas por el Partido Conservador. Pero el caso m\u00e1s escandaloso ocurri\u00f3 con la elaboraci\u00f3n de las ternas para nombrar a los magistrados de la Sala Disciplinaria del Consejo Superior de la Judicatura. En este caso, cada partido de la coalici\u00f3n puso su magistrado.<\/p>\n<p>La manipulaci\u00f3n del mecanismo de la terna que hace el Presidente no ser\u00eda tan grave si sus candidatos fueran buenos. Pero ese no es el caso. Lo que sucede hoy con la terna para nombrar fiscal es lo que ha sucedido casi siempre: o los candidatos no tienen ni malicia del tema para el cual est\u00e1n postulados o, peor a\u00fan, est\u00e1n \u00e9ticamente cuestionados.<\/p>\n<p>Una de las claves del poder uribista consiste en escoger gente que tenga una lealtad pol\u00edtica a toda prueba, lo cual se consigue con cierta facilidad cuando se nombra gente mediocre y falta de car\u00e1cter. Ese es el perfil del funcionario que hoy, despu\u00e9s de siete a\u00f1os de ejercicio abusivo del poder nominador por parte del Presidente, ha copado casi todos los cargos del Estado. La horda de funcionarios anodinos y sumisos ha acabado con lo poco de gobierno eficiente y de control pol\u00edtico que alg\u00fan d\u00eda hubo en Colombia.<\/p>\n<p>Eso es lo que la Corte Suprema trata de decir, en su lenguaje jur\u00eddico, cuando descalifica la terna que le envi\u00f3 el Presidente para nombrar fiscal.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>President Uribe&#8217;s authoritarian personality has multiple synthoms.
