{"id":26458,"date":"2009-10-01T00:00:00","date_gmt":"2009-10-01T05:00:00","guid":{"rendered":"https:\/\/www.dejusticia.org\/the-right-to-judicial-independence\/"},"modified":"2017-04-11T07:32:35","modified_gmt":"2017-04-11T12:32:35","slug":"the-right-to-judicial-independence","status":"publish","type":"post","link":"https:\/\/develop.dejusticia.org\/en\/the-right-to-judicial-independence\/","title":{"rendered":"The right to judicial independence"},"content":{"rendered":"<p>Con coyunturas como la del referendo, el poder judicial se juega todo su prestigio y es all\u00ed cuando la responsabilidad de los jueces es superlativa. <\/p>\n<p>La independencia judicial no debe entenderse como una prebenda de los jueces, sino como un derecho ciudadano<\/p>\n<p>Si hay algo que debe caracterizar particularmente a un juez, eso es la independencia. Se trata de un atributo que por manido y supuesto, suele permanecer por ah\u00ed como entre un caj\u00f3n. Pero de vez en cuando, aparecen circunstancias que imponen la necesidad de ventilarlo y volver sobre sus principales rasgos.<\/p>\n<p>Basta mencionar solo dos asuntos socialmente claves que en estos d\u00edas ocupan la atenci\u00f3n de los jueces \u2013el referendo reeleccionista y las bases militares-, para justificar el llamado de atenci\u00f3n sobre la pertinencia de poner en el debate p\u00fablico la independencia judicial. Y sobre todo la necesidad de tom\u00e1rsela en serio.<\/p>\n<p>En la idea intuitiva de la independencia judicial, prevalecen dos cosas: (i) una noci\u00f3n institucional m\u00e1s bien ingenua -alimentada por un equ\u00edvoco entendimiento de la teor\u00eda de la separaci\u00f3n de poderes- que muestra al Poder Judicial como un compartimiento diferente y hasta distante del Legislativo y del Ejecutivo y (ii) una dispensa corporativa propia de los jueces. Este entendimiento debe ser complementado con una noci\u00f3n de independencia judicial m\u00e1s cercano a la ciudadan\u00eda.<\/p>\n<p>Como al fin de cuentas el ciudadano de a pie es el \u201cpaganini\u201d de los debates acad\u00e9micos, pol\u00edticos y jur\u00eddicos, tiene sentido que se lo involucre directamente con un fen\u00f3meno que en abstracto pareciera no tocarlo. Por ello es un acierto que la primera norma del C\u00f3digo Iberoamericano de \u00c9tica Judicial \u2013que suscribi\u00f3 Colombia- est\u00e9 orientada a precisar que la independencia judicial no otorga un privilegio al juez, sino que \u201csu raz\u00f3n de ser es la de garantizar a los ciudadanos el derecho a ser juzgados con par\u00e1metros jur\u00eddicos, como forma de evitar la arbitrariedad y de realizar los valores constitucionales y salvaguardar los derechos fundamentales\u201d.<\/p>\n<p>Y es esta dimensi\u00f3n de independencia judicial como \u201cderecho ciudadano\u201d, la que me parece que debe resaltarse en coyunturas como la que actualmente tiene al poder judicial en la mira ciudadana. Esta aproximaci\u00f3n le hace cobrar sentido a otras propiedades de la independencia mencionadas en el mismo C\u00f3digo, tales como la toma de decisiones \u201csin dejarse influir real o aparentemente por factores ajenos al Derecho mismo\u201d, pues el \u201cEl juez, con sus actitudes y comportamientos, debe poner de manifiesto que no recibe influencias -directas o indirectas- de ning\u00fan otro poder p\u00fablico o privado, bien sea externo o interno al orden judicial\u201d y por ello tiene \u201cel derecho y el deber de denunciar cualquier intento de perturbaci\u00f3n de su independencia\u201d, y no debe interferir en la independencia de sus colegas .<\/p>\n<p>Los ejemplos tra\u00eddos a cuento para ilustrar la importancia de la independencia judicial \u2013referendo y bases- pueden ampliarse sustancialmente, pero son suficientes para ilustrar escenarios en donde las alertas ciudadanas se encienden y se espera lo mejor de los jueces. Sin duda se trata de momentos en los que la siempre fr\u00e1gil legitimaci\u00f3n del poder judicial se juega todo su prestigio y por ello aqu\u00ed la responsabilidad de los jueces es superlativa.<\/p>\n<p>Las especulaciones ciudadanas sobre lo que har\u00e1n nuestros jueces en torno al referendo reeleccionista y las bases militares, deben ser entendidas entonces en el ejercicio de un derecho leg\u00edtimo: el de la independencia judicial, lo que se traduce en una exigencia cuya contracara es el deber de los jueces de tomar decisiones sin dejarse influir real o aparentemente.<\/p>\n<p>No parece mucho pedir, pues los jueces lo saben y suelen actuar con responsabilidad e independencia. Pero en coyunturas especiales como las que imponen temas tan sensibles socialmente, no est\u00e1 dem\u00e1s recordarle a los jueces las bondades de aquel proverbio sobre la fidelidad de la mujer del rey. Los jueces entonces no solo deben ser fieles a la independencia judicial, sino dar muestras de que efectivamente la ejercen. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>In situations such as the referendum, the judicial power&#8217;s prestige is at risk.
