{"id":26510,"date":"2009-12-01T00:00:00","date_gmt":"2009-12-01T05:00:00","guid":{"rendered":"https:\/\/www.dejusticia.org\/internal-displacement-and-local-budgets\/"},"modified":"2017-04-11T07:33:18","modified_gmt":"2017-04-11T12:33:18","slug":"internal-displacement-and-local-budgets","status":"publish","type":"post","link":"https:\/\/develop.dejusticia.org\/en\/internal-displacement-and-local-budgets\/","title":{"rendered":"Internal displacement and local budgets"},"content":{"rendered":"<p>Ni los gobiernos locales ni el Nacional est\u00e1n asumiendo como se debe la atenci\u00f3n a los desplazados.<\/p>\n<p>El desgano de las autoridades locales para aumentar los presupuestos destinados a los desplazados y el previsible control presupuestal del gobierno para el a\u00f1o 2010, muestran un panorama poco optimista para superar el estado de cosas inconstitucional en materia de desplazamiento forzado. <\/p>\n<p>Esta semana vence el plazo de sesiones ordinarias de asambleas departamentales y concejos municipales en donde se viene tratando, entre otras cosas, la aprobaci\u00f3n del presupuesto de municipios y departamentos para 2010. Muy seguramente habr\u00e1 en muchos casos sesiones extras en diciembre pero, en todo caso, los presupuestos deber\u00e1n estar aprobados antes de finalizar el a\u00f1o. Si las asambleas y concejos no acogen la propuesta hecha por los gobiernos departamental y municipal, estos podr\u00e1n aprobarlos por decreto.<\/p>\n<p>No est\u00e1 dem\u00e1s decir que la ejecuci\u00f3n de los programas y proyectos que contemplen los planes de desarrollo local, como parte de la pol\u00edtica p\u00fablica correspondiente, dependen en gran medida de los presupuestos que se aprueben. Y all\u00ed cabe entonces la reflexi\u00f3n que nos interesa, relacionada con la plata que se necesita para atender la mayor tragedia humanitaria que padece nuestro pa\u00eds: el desplazamiento forzado por la violencia. <\/p>\n<p>Con ocasi\u00f3n de las \u00f3rdenes impartidas por la Corte Constitucional a partir de la sentencia que declar\u00f3 el desplazamiento forzado como un estado de cosas inconstitucional (sentencia T-025\/04), el Ministerio del Interior y de Justicia compil\u00f3 y sistematiz\u00f3 en junio de este a\u00f1o 501 informes rendidos por igual n\u00famero de entidades territoriales \u2013departamentos y municipios-, a quienes les fue solicitada informaci\u00f3n sobre falencias padecidas para atender la poblaci\u00f3n desplazada en las regiones, as\u00ed como los compromisos que podr\u00edan adquirir. De todas las dolencias reportadas, la m\u00e1s frecuente fue la presupuestal y el compromiso no pas\u00f3 de la gesti\u00f3n para obtenerlos. <\/p>\n<p>Esta queja fue constatada por el Consejo Noruego para Refugiados en un trabajo que incluy\u00f3 el an\u00e1lisis detallado de 21 planes de desarrollo en Magdalena, Norte de Santander y Nari\u00f1o. Los hallazgos, si bien no son conclusivos para todo el pa\u00eds \u2013  pues la muestra no es representativa-, s\u00ed se\u00f1ala una tendencia de lo que puede estar ocurriendo. <\/p>\n<p>En la m\u00e1s reciente decisi\u00f3n tomada por la Corte sobre el tema (auto 314 de octubre 29 de 2009), se dispuso la realizaci\u00f3n de varias sesiones t\u00e9cnicas sobre coordinaci\u00f3n y corresponsabilidad entre la Naci\u00f3n y las entidades territoriales. Esta nueva orden de la Corte est\u00e1 en sinton\u00eda tanto con la propuesta de la Comisi\u00f3n de Seguimiento de la Pol\u00edtica P\u00fablica sobre Desplazamiento Forzado de formar un Sistema Integrado de Corresponsabilidad y con las propias exigencias que sobre coordinaci\u00f3n y corresponsabilidad afin\u00f3 la Ley 1190 de 2008. La primera de las audiencias se realizar\u00e1 el pr\u00f3ximo 3 de diciembre y est\u00e1n programadas seis m\u00e1s de aqu\u00ed a junio del a\u00f1o entrante, con el fin de sentar a los responsables locales del tema, particularmente para que propongan soluciones a las falencias por ellos mismos se\u00f1aladas, dentro de las cuales, como se dijo, descuella la presupuestal. <\/p>\n<p>Aqu\u00ed laten dos problemas que en su momento deber\u00e1 analizar la Corte: en general las autoridades locales no destinan recursos propios a la atenci\u00f3n de los desplazados \u2013o lo hacen de modo muy precario, atendida la dimensi\u00f3n del problema- y piden permanentemente y con raz\u00f3n la ayuda de las autoridades nacionales. <\/p>\n<p>El asunto es m\u00e1s dram\u00e1tico en los casos de entes territoriales que se encuentran en quiebra y que por lo mismo se sometieron a acuerdos de reestructuraci\u00f3n de pasivos (Ley 550\/99), pues tal situaci\u00f3n suele utilizarse como excusa para evadir sus responsabilidades frente a los desplazados, a pesar de que jur\u00eddicamente dichos acuerdos no son obst\u00e1culo para cumplir las obligaciones legales. <\/p>\n<p>Por su parte, las autoridades nacionales culpan a las locales de no hacer los esfuerzos suficientes para atender el problema y, cuando deciden apoyar, lo hacen a trav\u00e9s de programas y proyectos orientados a atender poblaci\u00f3n vulnerable en general, con lo cual se traslapa la exigencia legal y jurisprudencial de destinar recursos espec\u00edficos para los desplazados, que adem\u00e1s de pobres son v\u00edctimas. <\/p>\n<p>Si las autoridades locales no se esfuerzan en fortalecer los presupuestos para ayudar a los desplazados y el gobierno nacional sigue desarrollando su proyecto de recentralizaci\u00f3n presupuestal \u2013lo que es previsible en un a\u00f1o de agite electoral- a sabiendas de que la responsabilidad legal de la ejecuci\u00f3n de las pol\u00edticas en general corresponde a los municipios, el panorama 2010 pinta desalentador para este grupo especial de v\u00edctimas del conflicto armado, a no ser que se produzca un milagro o que los organismos de control cumplan con su misi\u00f3n constitucional.
