{"id":26678,"date":"2010-05-19T00:00:00","date_gmt":"2010-05-19T05:00:00","guid":{"rendered":"https:\/\/www.dejusticia.org\/vicepresidency-and-human-rights-policy\/"},"modified":"2017-04-11T07:35:35","modified_gmt":"2017-04-11T12:35:35","slug":"vicepresidency-and-human-rights-policy","status":"publish","type":"post","link":"https:\/\/develop.dejusticia.org\/en\/vicepresidency-and-human-rights-policy\/","title":{"rendered":"Vicepresidency and Human Rights policy"},"content":{"rendered":"<p>Como el vicepresidente de la Rep\u00fablica tiene por funci\u00f3n principal reemplazar al presidente en sus faltas absolutas o temporales y esto suele ser realmente excepcional -pues los viajes al extranjero del primer mandatario los cubre el ministro delegatario-, el vicepresidente queda por cuenta del presidente quien le puede recomendar \u201cmisiones o encargos especiales y designarle en cualquier cargo de la Rama Ejecutiva\u201d.<\/p>\n<p>Despu\u00e9s de la reinstitucionalizaci\u00f3n del cargo en la Constituci\u00f3n del 91, quiz\u00e1 la misi\u00f3n m\u00e1s importante que se le ha encomendado a un vicepresidente ha sido la de Alto Consejero Presidencial para los DDHH. Bajo ese encargo, Gustavo Bell sac\u00f3 lo que durante la administraci\u00f3n Pastrana fue la \u201cPol\u00edtica de promoci\u00f3n, respecto y garant\u00eda de los DDHH y aplicaci\u00f3n del DIH\u201d. <\/p>\n<p>El nuevo y actual vicepresidente no sigui\u00f3 la l\u00ednea de su antecesor y, por supuesto, hizo caso omiso a la pol\u00edtica de DDHH propuesta por Bell-Pastrana. El gobierno Uribe tampoco consider\u00f3 en su estructura burocr\u00e1tica la figura de la consejer\u00eda para DDHH creada desde el gobierno Barco, ni la Comisi\u00f3n de DDHH que instituy\u00f3 C\u00e9sar Gaviria con ocasi\u00f3n del Acuerdo de Paz celebrado con la corriente de Renovaci\u00f3n Socialista, \u201ccomo una instancia de concertaci\u00f3n de pol\u00edticas y medidas de promoci\u00f3n y protecci\u00f3n de los Derechos Humanos\u201d. A cambio de ello al vicepresidente se le atribuy\u00f3 la mera condici\u00f3n de supervisor del Programa presidencial de DDHH y DIH creado en la administraci\u00f3n Pastrana y que actualmente dirige Carlos Franco. <\/p>\n<p>Ya es un lugar com\u00fan afirmar que en el balance de la seguridad democr\u00e1tica, la pol\u00edtica de DDHH no ocup\u00f3 el lugar privilegiado que le corresponde, tal como lo muestran la infraestructura que tuvo el desarrollo del tema, los informes de organismos internacionales que tanto le chocan al gobierno y las propias observaciones hechas en su momento por instituciones nacionales como la Procuradur\u00eda General de la Naci\u00f3n \u2013la de Edgardo Maya- o la propia Corte Constitucional \u2013por ejemplo, las decisiones sobre desplazamiento forzado o salud-. <\/p>\n<p>Los programas de gobierno de los actuales candidatos a la presidencia no dejan ver con claridad lo que sigue en materia de pol\u00edtica p\u00fablica de DDHH. Tampoco los candidatos a presidente y vicepresidente parecen preocuparse demasiado por el asunto. \u00bfSer\u00e1 que \u00e9stos \u00faltimos no est\u00e1n suficientemente informados del encargo que puede tocarles? Si deciden desmontarse del tema \u2013por la raz\u00f3n que sea-, \u00bfcu\u00e1l es la orientaci\u00f3n m\u00e1s gruesa que tienen los candidatos que permita a los electores saber por d\u00f3nde va la cosa? <\/p>\n<p>Tampoco es garant\u00eda, claro est\u00e1, que al hacerse cargo del tema el vicepresidente, todo saldr\u00e1 bien. La pol\u00edtica de DDHH de la administraci\u00f3n Pastrana cont\u00f3 con una infraestructura adecuada, pero no tuvo el desarrollo esperado. La experiencia reciente no es la mejor muestra de compromiso real con los DDHH \u2013como lo mostrar\u00eda el solo hecho de la extradici\u00f3n de los autores de cr\u00edmenes de lesa humanidad que dejaron a las v\u00edctimas sin verdad, ni justicia, ni reparaci\u00f3n- y ni siquiera de tacto diplom\u00e1tico \u2013como lo mostr\u00f3 la perla que solt\u00f3 el vicepresidente Santos y que en buena parte evit\u00f3 la extradici\u00f3n a Colombia del mercenario Yair Klein-.<\/p>\n<p>Sea porque se mantenga la estructura burocr\u00e1tica vigente, o porque se decida volver a revivir formas burocr\u00e1ticas anteriores, o porque se quieran inventar unas nuevas y m\u00e1s eficaces, lo cierto es que la pol\u00edtica de derechos humanos en Colombia exige una infraestructura sofisticada y, especialmente, una acci\u00f3n y voluntad pol\u00edtica decidida, que tenga la capacidad de remover los numerosos obst\u00e1culos con los que suele encontrarse su desarrollo. Y parece que nadie mejor para intentar hacerlo que el vicepresidente. \u00bfO qu\u00e9 estar\u00e1n pensando los actuales proyectos de vices? <\/p>\n","protected":false},"excerpt":{"rendered":"<p>The role of the vice president is crucial in the implementation of human rights public policy.
