La Corte Constitucional colombiana, en un reciente caso de violaci\u00f3n al derecho a la consulta previa del pueblo Embera Dobid\u00e1, dio un paso importante en el reconocimiento de la diversidad cultural, y en la protecci\u00f3n efectiva de la pervivencia y de los derechos de los grupos \u00e9tnicos cuando una medida o un proyecto es susceptible de afectarlos directamente. En la sentencia T-129 de 2011, la Corte regul\u00f3 la exigencia del consentimiento libre, previo e informado al determinar que debe ser el objetivo de cualquier proceso de consulta previa y que se requiere siempre que sea la opci\u00f3n menos lesiva para garantizar la pervivencia de los grupos \u00e9tnicos ante cualquier medida o proyecto que pueda afectarlos gravemente. Con estas consideraciones, y aplicando el principio pro homine, la Corte estableci\u00f3 que tiene prevalencia la integridad y pervivencia f\u00edsica y cultural de los grupos \u00e9tnicos frente a las visiones mayoritarias sobre los conceptos de \u201cdesarrollo\u201d o \u201cprogreso\u201d, con lo cual abri\u00f3 una ventana para la protecci\u00f3n efectiva de sus derechos en un contexto de expansi\u00f3n de la econom\u00eda extractiva en el pa\u00eds y de negativa reiterada por parte del gobierno nacional de aceptar el derecho al consentimiento libre, previo e informado. <\/p>\n
