Dos cosas quedan claras con la nueva terna presentada a la Corte Suprema para la elecci\u00f3n del Fiscal. La primera es pol\u00edtica: con ella, Santos termina de imprimirle un sello pragm\u00e1tico y de centro a sus nombramientos, tan distinto del que fue la marca registrada de Uribe. Lo que tienen en com\u00fan Carlos Gustavo Arrieta, Juan Carlos Esguerra y Viviane Morales es que son juristas con trayectoria (aunque mucho m\u00e1s aqu\u00e9llos que \u00e9sta), liberales y desmarcados del n\u00facleo pol\u00edtico del oficialismo (de nuevo, m\u00e1s aqu\u00e9llos que \u00e9sta). Atr\u00e1s quedan los candidatos de las entra\u00f1as conservadoras o salidos directamente del entorno personal de Uribe.<\/p>\n

La segunda consecuencia es m\u00e1s institucional y jur\u00eddica: a la Corte Suprema no le queda otro camino que elegir Fiscal \u2013y pronto\u2014de esta terna. Adem\u00e1s de que no hay estado de derecho que aguante una interinidad eterna en el organismo m\u00e1s poderoso del sistema penal, la terna responde con creces a las objeciones de fondo de la Corte. Contra lo que dice Fernando Londo\u00f1o hoy en El Tiempo, las reservas no ten\u00edan que ver con que los candidatos fueran o no penalistas, sino con que fueran los abogados personales de Uribe. En otras palabras: la objeci\u00f3n clave, en la que la Corte ten\u00eda toda la raz\u00f3n, es que no se pod\u00eda dejar la Fiscal\u00eda en manos de un comod\u00edn del Gobierno, mucho menos cuando el nuevo Fiscal debe decidir casos fundamentales que involucran a funcionarios del uribismo, desde la yidispol\u00edtica hasta las chuza-das.<\/p>\n

La independencia frente a los gobiernos y las fuerzas pol\u00edticas es la virtud fundamental de un buen fiscal para Colombia. Por eso, aunque la Corte podr\u00eda escoger a cualquiera de la terna actual, me atrevo a lanzar mi \u201cranking\u201d de elegibilidad:<\/p>\n

3. Viviane Morales<\/p>\n
