As\u00ed lo ha reconocido la Corte Constitucional en varios pronunciamientos, como el Auto 092 de 2008, en donde describe y analiza la situaci\u00f3n de las mujeres desplazadas. En dicha decisi\u00f3n, la Corte reconoce que las mujeres, especialmente las pobres y quienes pertenecen a minor\u00edas \u00e9tnicas, son afectadas de manera diferenciada por la violencia debido a la presencia de patrones de discriminaci\u00f3n que las afectan en sus vidas cotidianas y que se acent\u00faan con el conflicto. As\u00ed, por ejemplo, adem\u00e1s, de enfrentar los riesgos generales derivados de la confrontaci\u00f3n armada, afrontan varios espec\u00edficos y diferenciados, como el riesgo de ser v\u00edctimas de diversas formas de violencia sexual.<\/p>\n<p>A pesar de que el reconocimiento de la situaci\u00f3n particular de las mujeres ha aumentado en el pa\u00eds, son pocos los avances que se han dado para enfrentar las afectaciones diferenciadas y el impacto desproporcionado del conflicto. Un ejemplo claro de la falta de medidas concretas destinadas a enfrentar la situaci\u00f3n de las mujeres y asegurar el goce efectivo de sus derechos es el proyecto de Ley de V\u00edctimas y Tierras que se discute actualmente en el Congreso.<\/p>\n<p>El Gobierno anunci\u00f3 que uno de los ejes principales del proyecto de ley ser\u00eda dar prioridad a mujeres y ni\u00f1os, para lo cual se definir\u00eda \u201cun enfoque diferencial para reparar a los sectores m\u00e1s vulnerables\u201d y se les garantizar\u00eda atenci\u00f3n especializada y prioritaria.<\/p>\n<p>Una revisi\u00f3n del proyecto de ley a la luz de lo anunciado por el Gobierno arroja un resultado muy pobre en materia de enfoque diferencial para la reparaci\u00f3n. Si bien el proyecto incluye como uno de sus principios generales el enfoque diferencial, las medidas de reparaci\u00f3n contempladas no parecen desarrollarlo y menos a\u00fan, responder al impacto desproporcionado del desplazamiento y del conflicto en las mujeres. As\u00ed, por ejemplo, las garant\u00edas de no repetici\u00f3n no incluyen medidas destinadas a enfrentar las formas de discriminaci\u00f3n y violencia que contribuyen a generar vulneraciones espec\u00edficas y diferenciadas en las mujeres.<\/p>\n<p>Este proyecto no es la \u00fanica pieza normativa que incluye como principio el enfoque diferencial de g\u00e9nero sin desarrollarlo en sus dem\u00e1s disposiciones. Algo similar ocurre con el Decreto que regula las medidas de protecci\u00f3n para v\u00edctimas y testigos de justicia y paz (1737 de 2010), en el que por orden de la Corte deb\u00eda incluirse un enfoque diferencial. De nuevo, este fue incorporado, pero solo en la enunciaci\u00f3n de principios, y no en su desarrollo.<\/p>\n<p>Estos elementos parecer\u00edan hacer parte de una estrategia pol\u00edtica en la cual se incluyen de manera formal y gen\u00e9rica enfoques diferenciales, pero sin mayor desarrollo. El resultado aparente ser\u00eda una ganancia en legitimidad, pero con poco compromiso serio con el goce efectivo de los derechos de las mujeres. En esta semana de la no violencia contra las mujeres, resulta importante analizar c\u00f3mo deber\u00eda avanzar el Estado a trav\u00e9s de su legislaci\u00f3n y pol\u00edticas p\u00fablicas en la erradicaci\u00f3n de la violencia en su contra.  <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Colombian women have been disproportionately affected by armed conflict.
