La designaci\u00f3n de Vivian Morales tiene aspectos positivos que pueden mejorar la labor de la Fiscal\u00eda; sin embargo, tambi\u00e9n puede tener riesgos a los cuales debemos pararle bolas desde ya.<\/p>\n<p>Lo bueno: el hecho que sea la primera Fiscal General mujer es positivo.  Ella puede darle un impulso m\u00e1s serio a los casos de violencia de g\u00e9nero, sobre todo los de violencia sexual durante el conflicto armado, que han sido m\u00e1s o menos ignorados durante a\u00f1os.  Morales ya ha mostrado una agenda de g\u00e9nero en el pasado, por ejemplo, en relaci\u00f3n con la ley de cuotas.<\/p>\n<p>Desde que fue ternada, Viviane Morales ha insistido tambi\u00e9n en que la Fiscal\u00eda debe darle la cara a la gente.  Esto es crucial, dado que la Fiscal\u00eda ha tenido serios problemas frente a la participaci\u00f3n de las v\u00edctimas en los procesos y tiene una cultura de muy limitada transparencia frente a la ciudadan\u00eda, sobre todo cuando se trata de permitir acceso a datos acerca de su gesti\u00f3n. La ciudadan\u00eda tiene muy pocas herramientar para controlar a la entidad.<\/p>\n<p>Los riesgos: Morales parece tener el perfil m\u00e1s pol\u00edtico de esta terna.  Arrieta y Esguerra tienen antecedentes que mostrar\u00edan m\u00e1s experiencia en la gesti\u00f3n de grandes instituciones.  Comparemos: Esguerra fue Constituyente, Ministro de Defensa y decano de la Javeriana.  Arrieta, quien parecer\u00eda haber sido el m\u00e1s acertado t\u00e9cnicamente en sus propuestas durante la audiencia, fue Consejero de Estado, Procurador y decano de los Andes.  Morales fue Representante y Senadora.  Estuvo en el Congreso 12 a\u00f1os.  Por supuesto, dedicarse a la pol\u00edtica no es malo, y de hecho, Morales es una muy buena jurista.  El riesgo est\u00e1 en que su vena pol\u00edtica se imponga sobre su orientaci\u00f3n jur\u00eddica, pues entonces la Fiscal\u00eda podr\u00eda continuar sin un claro liderazgo en estrategia investigativa y con falencias en su gesti\u00f3n p\u00fablica.<\/p>\n<p>Su perfil m\u00e1s pol\u00edtico puede tener un riesgo adicional: su cercan\u00eda al Uribismo. Morales defendi\u00f3 la constitucionalidad del referendo reeleccionista, como el Procurador, con argumentos que no resultaron muy convincentes.<\/p>\n<p>Si Morales asume un manejo m\u00e1s pol\u00edtico que t\u00e9cnico, la Fiscal\u00eda seguir\u00e1 siendo lenta, burocratizada, formalista e ineficaz, como ahora.  Adem\u00e1s, le quedar\u00e1 dif\u00edcil manejar bien los casos que le toca asumir personalmente (esto incluye a varios de los altos funcionarios que presumiblemente ordenaron las chuzadas).  Y peor a\u00fan, puede sucumbir ante la presi\u00f3n del uribismo respecto de m\u00faltiples procesos contra funcionarios del Gobierno anterior.<\/p>\n<p>Por ahora, lo importante es que Viviane Morales es una abogada seria y representa una mejor opci\u00f3n que la mayor\u00eda de los ternados a los que nos ten\u00eda acostumbrados el anterior nominador.  Pero tiene el reto de asumir su investidura con autonom\u00eda y conciencia de los problemas de nivel t\u00e9cnico y de gesti\u00f3n a los que se enfrenta.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>At last we have a new Attorney General.
