{"id":27186,"date":"2011-06-09T00:00:00","date_gmt":"2011-06-09T05:00:00","guid":{"rendered":"https:\/\/www.dejusticia.org\/what-to-do-with-immediate-presidential-re-election\/"},"modified":"2017-04-11T07:43:36","modified_gmt":"2017-04-11T12:43:36","slug":"what-to-do-with-immediate-presidential-re-election","status":"publish","type":"post","link":"https:\/\/develop.dejusticia.org\/en\/what-to-do-with-immediate-presidential-re-election\/","title":{"rendered":"What to do with immediate presidential re-election?"},"content":{"rendered":"<p>En la conmemoraci\u00f3n de los 20 a\u00f1os de la Constituci\u00f3n de 1991 el expresidente C\u00e9sar Gaviria asegur\u00f3 que lo peor que le hab\u00eda pasado a la Constituci\u00f3n hab\u00eda sido la reforma que permiti\u00f3 la reelecci\u00f3n presidencial.<\/p>\n<p>Con esa idea estamos de acuerdo muchos colombianos. La reelecci\u00f3n se estableci\u00f3 para favorecer al expresidente Uribe  y eso es inaceptable desde la perspectiva democr\u00e1tica, pues con ello se cambiaron las reglas de juego en beneficio del gobernante de turno. Adem\u00e1s, con el tiempo nos hemos enterado de todas las irregularidades que rodearon la aprobaci\u00f3n de la reforma constitucional.<\/p>\n<p>Igualmente, para el expresidente Uribe no fueron suficientes 8 a\u00f1os de gobierno y busc\u00f3 que se autorizara una segunda reelecci\u00f3n inmediata, prop\u00f3sito que en buena hora frustr\u00f3 la Corte Constitucional. Y, finalmente, los colombianos nos hemos enterado en forma paulatina del ambiente de corrupci\u00f3n que caracteriz\u00f3 al anterior gobierno y que fue favorecido por los intentos reeleccionistas.<\/p>\n<p>La pregunta que queda pendiente es qu\u00e9 se debe hacer ahora con la norma constitucional que autoriza la reelecci\u00f3n presidencial inmediata. Creo que se puede afirmar que esa reforma tuvo un origen espurio. Pero, entonces, \u00bfqu\u00e9 hacemos con ella?<\/p>\n<p>Algunos han afirmado que debe eliminarse la norma que autoriza la reelecci\u00f3n presidencial inmediata, fundamentalmente porque ella facilita el surgimiento de reg\u00edmenes autoritarios.<\/p>\n<p>Yo creo que la norma debe mantenerse, es decir que la Constituci\u00f3n debe permitir la reelecci\u00f3n presidencial inmediata por una sola vez. Eso permite contrarrestar uno de los grandes problemas de los reg\u00edmenes pol\u00edticos latinoamericanos, cual es el de los t\u00e9rminos presidenciales cortos que no permiten cumplir con los programas y planes de gobierno. De esta manera, si un presidente est\u00e1 haciendo un buen gobierno puede ser confirmado en el cargo por los ciudadanos, pero si estos no aprueban su gesti\u00f3n pueden sancionarlo neg\u00e1ndole la reelecci\u00f3n.<\/p>\n<p>Las objeciones expuestas por los que favorecen la eliminaci\u00f3n de la reelecci\u00f3n presidencial inmediata son serias. Sin embargo, considero que Colombia ha demostrado que cuenta con ciudadanos e instituciones en capacidad de oponerse a los \u00e1nimos autoritarios.
