Pero no es lo \u00fanico que importa. Los proyectos de reforma judicial presentados por el Gobierno y el Consejo de Estado han debido preocuparse tambi\u00e9n por lograr que la Rama Judicial sea m\u00e1s transparente, responsable y democr\u00e1tica.<\/p>\n<p>La Constituci\u00f3n debe proteger a los jueces para que puedan decidir de manera imparcial, libres de presiones. En Colombia dicha protecci\u00f3n es a\u00fan m\u00e1s importante pues es m\u00e1s f\u00e1cil la captura de la justicia por organizaciones criminales. Y las chuzadas y otras agresiones durante el gobierno anterior muestran que sigue habiendo pol\u00edticos muy poderosos que no creen en la autonom\u00eda judicial.<\/p>\n<p>Sin embargo, esto no justifica tener \u00f3rganos judiciales impermeables a todo lo que no venga de la misma Rama, que es a donde apuntan los proyectos de Reforma a la Justicia presentados en el Congreso. Esto, respecto de dos temas: la administraci\u00f3n de la Rama Judicial y la elecci\u00f3n de los magistrados.<\/p>\n<p>Seg\u00fan el proyecto del Gobierno, la administraci\u00f3n de la Rama estar\u00eda a cargo de una Sala de Gobierno del Consejo Superior integrada por personas provenientes \u00fanicamente de las altas cortes o la rama judicial (el Ministro de Justicia, la Fiscal y la gerente de la Rama podr\u00edan asistir pero no votar).<\/p>\n<p>El proyecto del Consejo de Estado es a\u00fan peor, pues adem\u00e1s de continuar con el aislamiento del Consejo Superior, crea un nivel de decisi\u00f3n adicional por encima de la Sala Administrativa, que agravar\u00eda lo difuso e ineficiente de la toma de decisiones, sin beneficios claros.<\/p>\n<p>En contrav\u00eda de estas propuestas, el Consejo Superior deber\u00eda estar integrado con representantes de diferentes sectores, para cuya designaci\u00f3n y labores se requieran mayores niveles de transparencia. Esto se puede lograr con una arquitectura institucional que, preserve la independencia por un lado, pero que simult\u00e1neamente exija m\u00e1s rendici\u00f3n de cuentas y permita la participaci\u00f3n efectiva de personas de distintos \u00e1mbitos profesionales, jur\u00eddicos y pol\u00edticos. Y eso es dif\u00edcil conseguirlo si el grupo est\u00e1 compuesto s\u00f3lo por personas que provienen de la Rama Judicial.<\/p>\n<p>Lo mismo sucede con la propuesta de designaci\u00f3n de magistrados de la Corte Suprema y el Consejo de Estado.  Los proyectos de reforma proponen retroceder hacia el sistema de cooptaci\u00f3n anterior a 1991, que era un esquema totalmente end\u00f3geno en el que los magistrados eleg\u00edan a sus propios reemplazos. La propuesta del gobierno al menos dice que la composici\u00f3n de la Corte debe ser diversa. Pero como la decisi\u00f3n se acaba tomando en un proceso cerrado, dudo que dicha disposici\u00f3n tenga efectos.<\/p>\n<p>Este proceso de elecci\u00f3n incentiva a elegir personas homog\u00e9neas, a reproducir una misma visi\u00f3n del derecho y a que estas cortes tengan una menor sensibilidad frente a los cambios sociales.<\/p>\n<p>Es menos peor el sistema actual, que es una cooptaci\u00f3n m\u00e1s ligera en la que los magistrados eligen a sus sucesores de listas que vienen del Consejo Superior. Pero ser\u00eda conveniente algo m\u00e1s abierto y transparente. (Ver ensayo)<\/p>\n<p>Otros pa\u00edses han solucionado esta eventual tensi\u00f3n que existe entre la independencia y el accountability previendo una incidencia importante de lo pol\u00edtico en los sistemas de elecci\u00f3n de Consejos de la Judicatura y de Cortes de Casaci\u00f3n.<\/p>\n<p>En esa misma direcci\u00f3n, en Colombia tal vez es posible crear un sistema administrativo y de nominaci\u00f3n de jueces que a la vez impida la captura externa y que responda m\u00e1s a la sociedad.
