{"id":27294,"date":"2011-12-02T00:00:00","date_gmt":"2011-12-02T05:00:00","guid":{"rendered":"https:\/\/www.dejusticia.org\/trans-forming-public-policy\/"},"modified":"2017-04-11T07:45:00","modified_gmt":"2017-04-11T12:45:00","slug":"trans-forming-public-policy","status":"publish","type":"post","link":"https:\/\/develop.dejusticia.org\/en\/trans-forming-public-policy\/","title":{"rendered":"Trans-forming public policy"},"content":{"rendered":"<p>En mayo de este a\u00f1o, la Corte Constitucional emiti\u00f3 una sentencia, muy poco mencionada en los medios de comunicaci\u00f3n, que en varios aspectos significa un avance para la comunidad LGBTI (Lesbianas, Gays, Bisexuales, Transgeneristas e Intersexuales) en Colombia. El fallo de la Corte fue emitido a partir de una tutela interpuesta por una mujer trans (es decir, naci\u00f3 con el sexo biol\u00f3gico masculino pero se construye con una identidad de g\u00e9nero femenina) quien aleg\u00f3 una situaci\u00f3n de discriminaci\u00f3n tras haber sido negada la entrada en dos ocasiones a fiestas en el Piso 30 del Hotel Tequendama en Bogot\u00e1.<\/p>\n<p>En la sentencia, la Corte constat\u00f3 que hay una presunci\u00f3n de discriminaci\u00f3n, y que existe una reiterada jurisprudencia del tribunal sobre la especial protecci\u00f3n por parte del Estado de la que gozan las personas LGBTI por ser un hecho notorio la discriminaci\u00f3n y vulnerabilidad social que afrontan. En este caso particular, sin embargo, no se pudo establecer un hecho de discriminaci\u00f3n debido a la falta de pruebas. <\/p>\n<p>No obstante, la Corte reconoce que hay una discriminaci\u00f3n generalizada que sufren las personas trans y por ello ordena a 11 entidades del orden nacional que, en articulaci\u00f3n con organizaciones del movimiento LGBTI, adelanten \u201cuna pol\u00edtica p\u00fablica integral nacional, constante y unificada con los entes territoriales para el sector LGBTI, que posibilite su socializaci\u00f3n y coadyuve a la convivencia pac\u00edfica, cumpliendo tambi\u00e9n los deberes y obligaciones correlativas.\u201d Este reconocimiento de la necesidad y urgencia de una pol\u00edtica p\u00fablica es muy favorable. <\/p>\n<p>En segundo lugar, la sentencia es tambi\u00e9n positiva al avanzar en un reconocimiento m\u00e1s concreto de la situaci\u00f3n de las personas trans en Colombia y adentrarse en la diversidad del transgenerismo y su especial situaci\u00f3n de discriminaci\u00f3n. Retoma con fuerza estudios, conceptos y documentos elaborados por el movimiento LGBTI, y ellos son examinados como documentos expertos que aportan al debate. El movimiento y las organizaciones LGBTI son las que m\u00e1s conocen la situaci\u00f3n global de derechos de esta poblaci\u00f3n, en algunos aspectos, por encima de entidades nacionales. <\/p>\n<p>De este modo, as\u00ed la Corte Constitucional no le haya reconocido una vulneraci\u00f3n al derecho a no ser discriminada a la accionante (lo cual puede tambi\u00e9n ser una muestra de que sigue siendo un reto probar la discriminaci\u00f3n jur\u00eddicamente), en este caso s\u00ed se reconoce que las personas trans en general experimentan una afectaci\u00f3n a derechos en un grado diferente al de los dem\u00e1s y que por ende son imperativas las medidas de pol\u00edtica p\u00fablica. Un pronunciamiento por parte de la Corte en este sentido siempre es bien recibido, especialmente en el tema de las personas trans, que a\u00fan tienen muchas carencias en materia de derechos. <\/p>\n<p>Ahora esperemos que las entidades involucradas tambi\u00e9n entiendan la importancia y urgencia del tema y cumplan con las ordenes dadas poniendo en marcha una pol\u00edtica p\u00fablica LGBTI nacional. Desde 2009, el Ministerio del Interior viene adelantando un trabajo en esta materia, y la sentencia de la Corte ofrece algunos elementos que ser\u00e1n importantes a tener en cuenta en este proceso. Especialmente establece criterios espec\u00edficos de responsabilidades de las instituciones y elementos a ser transformados en las pol\u00edticas de las mismas.
