{"id":27550,"date":"2012-06-18T00:00:00","date_gmt":"2012-06-18T05:00:00","guid":{"rendered":"https:\/\/www.dejusticia.org\/in-the-presidential-palace-the-quota-act-does-not-stick\/"},"modified":"2017-04-11T07:48:33","modified_gmt":"2017-04-11T12:48:33","slug":"in-the-presidential-palace-the-quota-act-does-not-stick","status":"publish","type":"post","link":"https:\/\/develop.dejusticia.org\/en\/in-the-presidential-palace-the-quota-act-does-not-stick\/","title":{"rendered":"In the Presidential Palace, the Quota Act does not stick"},"content":{"rendered":"<p>Un asistente, que era funcionario de la Alcald\u00eda, le dijo entonces: \u201cMuy interesante su charla, profesor, pero la verdad es que esa ley aqu\u00ed no ha pegado y no parece que vaya a pegar\u201d.<\/p>\n<p>Esta an\u00e9cdota muestra que algunos funcionarios colombianos no ven las leyes como mandatos que tienen que cumplir sino como modas o meras sugerencias, que pueden o no seguir. Las leyes pueden entonces \u201cno pegar\u201d.<\/p>\n<p>Que eso suceda en una Alcald\u00eda es ya grave. Pero que ocurra en el alto gobierno es grav\u00edsimo. Y desafortunadamente eso pasa con la Ley 581 de 2000 o Ley de Cuotas, que parece que no pega en la Casa de Nari\u00f1o.<\/p>\n<p>Esa ley ordena, entre otras cosas, que al menos un 30% de los cargos de m\u00e1ximo nivel decisorio del Estado tiene que ser desempe\u00f1ado por mujeres. El presidente Santos no es partidario de esa cuota obligatoria, como lo se\u00f1al\u00f3 el 26 de abril en un seminario en el Instituto de Ciencia Pol\u00edtica, pues considera que las mujeres deben acceder a los cargos por m\u00e9ritos. Y decidi\u00f3 entonces inaplicar la cuota en relaci\u00f3n con el m\u00e1ximo nivel del gobierno central, que es el consejo de ministros.<\/p>\n<p>El 17 de mayo, el presidente nombr\u00f3 a Germ\u00e1n Vargas como ministro de Vivienda en reemplazo de Beatriz Elena Uribe. Y a su vez, para reemplazar a Vargas, nombr\u00f3 como ministro del Interior a Federico Renjifo. Con esas designaciones, el n\u00famero de ministras pas\u00f3 de 5 a 4 de los 16 ministerios existentes. El porcentaje de mujeres en el gabinete se redujo de 31% a 25%, con lo cual el presidente incumpli\u00f3 la Ley de Cuotas.<\/p>\n<p>El presidente puede obviamente discrepar de las cuotas obligatorias y puede incluso proponer su reforma, pero es inaceptable que no las cumpla, ya que la ley est\u00e1 vigente y adem\u00e1s ya fue declarada constitucional por la Corte Constitucional, por lo cual nadie puede invocar la excepci\u00f3n de inconstitucionalidad.<\/p>\n<p>Esa decisi\u00f3n presidencial no s\u00f3lo vicia de nulidad los nombramientos de Vargas y Renjifo, como lo han argumentado varias demandas judiciales (incluida una que Dejusticia present\u00f3 conjuntamente con Sisma Mujer y la Red Nacional de Mujeres), sino que sienta un p\u00e9simo precedente: un funcionario puede inaplicar aquella ley que no comparta, pues si el presidente lo hace, \u00bfpor qu\u00e9 no puede hacerlo otro servidor p\u00fablico?<\/p>\n<p>Pero, adem\u00e1s, las cuotas obligatorias siguen teniendo pleno sentido, pues en Colombia persiste una aguda discriminaci\u00f3n profesional contra las mujeres. No es que las mujeres no lleguen a ministras, superintendentas o magistradas porque carezcan de m\u00e9ritos o de formaci\u00f3n suficiente, como parece creerlo el presidente. Lo que pasa es que subsiste una discriminaci\u00f3n sutil que les impide llegar a estos cargos decisorios, pues muchas de ellas tienen hoy formaci\u00f3n profesional igual o incluso superior a los hombres, que siguen sin embargo llegando en forma abrumadora a esos puestos.<\/p>\n<p>El asunto no es entonces de m\u00e9rito sino de discriminaci\u00f3n de g\u00e9nero para llegar a cargos decisorios. Esta discriminaci\u00f3n no es expl\u00edcita ni tiene fundamento legal, pero persiste con mucha fuerza. Algunos estudios hablan por ello de la existencia de un \u201ctecho de cristal\u201d que impide que las mujeres accedan a los puestos m\u00e1s prestigiosos y poderosos, a pesar de tener todo el m\u00e9rito y la formaci\u00f3n para desempe\u00f1arlos. La experiencia comparada ha mostrado adem\u00e1s que las cuotas obligatorias son la forma m\u00e1s eficaz de quebrar ese techo de cristal y lograr r\u00e1pidamente una mayor equidad de g\u00e9nero en estos cargos decisorios.
