The high courts facing the public."},"content":{"rendered":"<p>De una parte, algunos magistrados, incluso actuando como presidentes de sus corporaciones, tienen una actitud medi\u00e1tica proactiva que a veces corresponde a quien busca votos.  Es clara la torpeza pol\u00edtica y jur\u00eddica, y adem\u00e1s el desprop\u00f3sito \u00e9tico, del espantajo de denuncia penal contra Orozco. Adicionalmente, en los \u00faltimos a\u00f1os hemos visto a magistrados soltando afirmaciones de tipo pol\u00edtico, que independientemente de su veracidad, son ajenas a sus funciones judiciales. <\/p>\n<p>Algunos ejemplos de esta imprudencia ante los medios, incluyen apoyar la propuesta de los centros de consumos de drogas; afirmar que congresistas \u201cresentidos\u201d intentaban una \u201crevancha\u201d contra la Corte Suprema; se\u00f1alar que exist\u00eda una &#8220;convivencia entre paramilitares y asesores de palacio&#8221;; indicar que Uribe traicion\u00f3 a la Corte Suprema en el debate de la tutela contra providencias judiciales, como consecuencia del apoyo de la Corte Constitucional a la reelecci\u00f3n; o sugerir que el Gobierno captur\u00f3 a la Fiscal\u00eda General de la Naci\u00f3n (ver minuto 5:50).<\/p>\n<p>Estas acciones medi\u00e1ticas de los magistrados no son propias de la mesura que exige su investidura; y le resta dignidad a su cargo de jueces imparciales que deber\u00edan estar por encima de las ri\u00f1as pol\u00edticas cotidianas.<\/p>\n<p>Pero esto no quiere decir que las altas cortes le hayan apostado a una relaci\u00f3n din\u00e1mica y cercana con la ciudadan\u00eda. Al rev\u00e9s: cuando se trata del escrutinio p\u00fablico de su desempe\u00f1o, las cortes dejan mucho qu\u00e9 desear. As\u00ed, aunque probablemente el principal papel de las cortes es la toma de decisiones judiciales que gu\u00eden al Estado y a los particulares en la soluci\u00f3n de problemas jur\u00eddicos, los sistemas de b\u00fasqueda de jurisprudencia de la Corte Suprema y el Consejo de Estado son desastrosos \u2013 cuando no est\u00e1n ca\u00eddos- (el de la Corte Constitucional es menos malo, pero est\u00e1 lejos de ser ideal).  Igualmente, cada vez se demora m\u00e1s la publicaci\u00f3n de sentencias -as\u00ed sea de decisiones ya tomadas y de alt\u00edsima sensibilidad p\u00fablica-.<\/p>\n<p>Tal vez el control m\u00e1s importante de un tribunal es la cr\u00edtica p\u00fablica a la calidad de sus sentencias, que a su vez son su principal mecanismo de expresi\u00f3n. Pero es dif\u00edcil acceder de forma ordenada y completa a la jurisprudencia.<\/p>\n<p>Tambi\u00e9n, como ya se ha repetido, el servicio que presta el Consejo Superior de la Judicatura en la producci\u00f3n de datos y el acceso a informaci\u00f3n acerca de la conducta del sistema judicial es muy limitado. Lo mismo sucede con el monitoreo y la evaluaci\u00f3n de pol\u00edticas judiciales, que son casi inexistentes, por lo que la ciudadan\u00eda tiene muy poca informaci\u00f3n acerca del desempe\u00f1o de los funcionarios judiciales y del manejo de los recursos de la Rama.<\/p>\n<p>Por \u00faltimo, los ciudadanos desconocen los criterios, si es que existen, con los cuales seleccionan algunos de los funcionarios de las altas cortes, o se eligen a los ternados para otras corporaciones (al parecer, la Corte Suprema se sac\u00f3 del sombrero la desafortunada nominaci\u00f3n de Ordo\u00f1ez para repetir en la Procuradur\u00eda).<\/p>\n<p>***<\/p>\n<p>Los magistrados deber\u00edan ser parcos en el debate medi\u00e1tico (as\u00ed el cubrimiento de algunos medios sea frustrante); y a la vez, ser abiertos, pacientes y accesibles frente al examen p\u00fablico de su desempe\u00f1o. No al rev\u00e9s.
