{"id":27833,"date":"2013-02-01T00:00:00","date_gmt":"2013-02-01T05:00:00","guid":{"rendered":"https:\/\/www.dejusticia.org\/an-unjustified-delay\/"},"modified":"2017-04-11T07:54:10","modified_gmt":"2017-04-11T12:54:10","slug":"an-unjustified-delay","status":"publish","type":"post","link":"https:\/\/develop.dejusticia.org\/en\/an-unjustified-delay\/","title":{"rendered":"An unjustified delay"},"content":{"rendered":"<p>Este lunes 4 de febrero una ni\u00f1a colombiana celebra su cumplea\u00f1os n\u00famero cinco junto a su familia \u2013 sus madres y su hermanito.<\/p>\n<p>Hace poco tambi\u00e9n se cumpli\u00f3 otro aniversario para la familia. El pasado 6 de enero se cumplieron cuatro a\u00f1os desde que las madres de esta ni\u00f1a solicitaron al ICBF la adopci\u00f3n de la ni\u00f1a por parte de la madre no biol\u00f3gica. Es un mero tr\u00e1mite burocr\u00e1tico, para que el Estado reconociera oficialmente lo que ya es un hecho \u2013 que son y siempre ser\u00e1n una familia.<\/p>\n<p>Sin embargo, ese tr\u00e1mite se ha convertido en una odisea para la familia, tras la negaci\u00f3n del ICBF con el \u00fanico argumento de que la adopci\u00f3n no es permitida para parejas del mismo sexo. Despu\u00e9s de varias instancias, el caso lleg\u00f3 a la Corte Constitucional hace ya casi dos a\u00f1os. Y ah\u00ed sigue.<\/p>\n<p><a href=\"http:\/\/www.elespectador.com\/opinion\/columna-378301-elemental-mi-querido-watson \" target=\"Blank\"> Ya se ha explicador<\/a> en t\u00e9rminos bastante claros el por qu\u00e9 no cabe duda de que la Corte deber\u00eda fallar a favor de la adopci\u00f3n.<\/p>\n<p>Pero adem\u00e1s de que deber\u00eda fallar a favor, lo deber\u00eda hacer ya. La espera de m\u00e1s de cuatro a\u00f1os no puede ser clasificada de otra forma que como una demora injustificada. El derecho al debido proceso, garantizado por <a href=\"http:\/\/www.secretariasenado.gov.co\/senado\/basedoc\/cp\/constitucion_politica_1991.html#29\" target=\"Blank\"> el art\u00edculo 29 de la Constituci\u00f3n<\/a>, establece que en toda clase de actuaciones judiciales y administrativas, las personas tienen derecho a \u201cun debido proceso p\u00fablico sin dilaciones injustificadas\u201d.<\/p>\n<p>Cuando se trata de ni\u00f1os y ni\u00f1as, entra a jugar el inter\u00e9s superior de sus derechos, entre ellos el derecho a tener una familia y no ser separado de ella. En el caso de esta ni\u00f1a, tiene una familia,<a href=\"http:\/\/www.corteconstitucional.gov.co\/relatoria\/2011\/c-577-11.htm\" target=\"Blank\"> reconocido por la misma Corte Constitucional<\/a> , pero el Estado hasta ahora se ha negado a otorgarle las protecciones legales que los dem\u00e1s ni\u00f1os y ni\u00f1as colombianas tienen al pertenecer a un n\u00facleo familiar.<\/p>\n<p>Reitero, se deber\u00eda tratar de un mero tr\u00e1mite burocr\u00e1tico, no m\u00e1s. Algo que deber\u00eda ser sencillo, que no tiene por qu\u00e9 tener dilaciones injustificadas.
