Y puede destituirlos e incluso matarlos pol\u00edticamente, pues puede inhabilitarlos para ejercer cualquier cargo por much\u00edsimos a\u00f1os.<\/p>\n<p>El proceso disciplinario es adem\u00e1s inquisitivo y con pocas garant\u00edas, pues la Procuradur\u00eda es juez y parte: investiga, acusa, practica las pruebas, falla y resuelve las apelaciones. Esto es grav\u00edsimo pues se trata de una instituci\u00f3n jer\u00e1rquica, en donde todos los funcionarios responden a las instrucciones del gran jefe, que es el procurador general, quien incluso puede asumir directamente cualquier proceso disciplinario.<\/p>\n<p>En Colombia, adem\u00e1s, hemos admitido que una falta disciplinaria puede estar descrita muy gen\u00e9ricamente en la ley. No requiere las precisiones y especificaciones de un delito. Por ejemplo, es una falta disciplinaria grav\u00edsima, que puede generar destituci\u00f3n e inhabilidad, que el funcionario ejerza sus tareas \u201ccon el prop\u00f3sito de defraudar otra norma de car\u00e1cter imperativo\u201d. Y es falta grave, que permite suspender a un funcionario e inhabilitarlo, que \u00e9ste incurra en retardos en la atenci\u00f3n de sus asuntos.<\/p>\n<p>Estas descripciones gen\u00e9ricas otorgan entonces una gran discrecionalidad al procurador para imponer sanciones, quien puede entonces, con un proceso disciplinario con pocas garant\u00edas, destituir a cualquier servidor p\u00fablico, incluso a aquellos que fueron elegidos popularmente, como los congresistas o alcaldes, con lo cual desconoce la voluntad de los votantes.<\/p>\n<p>Algunos objetar\u00e1n que exagero pues la sanci\u00f3n disciplinaria puede ser impugnada ante la justicia, en especial ante la jurisdicci\u00f3n administrativa. Y eso es cierto, pero el problema es que, por la congesti\u00f3n y morosidad de la justicia, esas revisiones judiciales son decididas much\u00edsimos a\u00f1os despu\u00e9s, cuando la carrera pol\u00edtica o administrativa del funcionario ya ha sido irreversiblemente aniquilada. Y el procurador que impuso la sanci\u00f3n est\u00e1 tranquilo, dedicado a otros oficios.<\/p>\n<p>Hace algunos unos a\u00f1os plante\u00e9 que la Procuradur\u00eda era una entidad redundante, que por econom\u00eda y simplificaci\u00f3n institucional deb\u00eda ser eliminada, o al menos radicalmente reducida, pues todas sus funciones son cumplidas por otras instituciones, que las pueden desarrollar en forma m\u00e1s especializada y eficiente.<\/p>\n<p>Hoy debo confesar que me equivoqu\u00e9: las actuaciones de Ord\u00f3\u00f1ez me han convencido de que la Procuradur\u00eda no es redundante; en realidad es peligrosa para el Estado de derecho, pues se presta a abusos y puede ser instrumentada pol\u00edticamente, con investigaciones disciplinarias selectivas.
