{"id":28247,"date":"2013-11-25T00:00:00","date_gmt":"2013-11-25T05:00:00","guid":{"rendered":"https:\/\/www.dejusticia.org\/progressive-winds-blow-in-from-administrative-law\/"},"modified":"2017-04-11T08:03:36","modified_gmt":"2017-04-11T13:03:36","slug":"progressive-winds-blow-in-from-administrative-law","status":"publish","type":"post","link":"https:\/\/develop.dejusticia.org\/en\/progressive-winds-blow-in-from-administrative-law\/","title":{"rendered":"Progressive Winds Blow In from Administrative Law"},"content":{"rendered":"<p>Las sentencias estructurales de la Corte Constitucional ya no son los \u00fanicos ejemplos de experimentalismo y progresismo judicial en el pa\u00eds. Hace pocos a\u00f1os sentencias de la Corte Constitucional como la T-025 de 2004 sobre desplazamiento o la T-760 de 2008 sobre salud sorprendieron a acad\u00e9micos locales y extranjeros por su creatividad judicial. <\/p>\n<p>Este tipo de sentencias, conocidas como estructurales, agrupaban tutelas para fallar sobre problemas de regulaci\u00f3n o pol\u00edtica p\u00fablica subyacentes a todas las reclamaciones individuales sobre un tema. De esta oleada de sentencias estructurales y de sus complejos procesos de seguimiento surgieron interesantes an\u00e1lisis acad\u00e9micos sobre los efectos transformadores de los fallos judiciales tanto en las pol\u00edticas p\u00fablicas como en las vidas de las personas \u2013v\u00e9ase por ejemplo el libro \u201cCortes y Cambio Social\u201d de C\u00e9sar Rodriguez Garavito y Diana Rodriguez Franco.<\/p>\n<p>Pero ahora, y probablemente como resultado de esas sentencias pioneras de la Corte Constitucional, estamos presenciando una nueva oleada de sentencias estructurales emitidas por jueces y tribunales administrativos. A diferencia de sus predecesoras, las sentencias provenientes de la jurisdicci\u00f3n administrativa no est\u00e1n basadas en reclamaciones individuales frente a vulneraciones de derechos fundamentales. Estos fallos que nos llegan de la jurisdicci\u00f3n administrativa est\u00e1n basados en reclamaciones que son planteadas por los litigantes en t\u00e9rminos de inter\u00e9s p\u00fablico y de derechos colectivos (acciones populares); adicionalmente, en ocasiones son los mismos litigantes quienes diagnostican el problema institucional o regulatorio que el juez debe entrar a analizar. Este nuevo experimentalismo progresista es muy saludable para causas como la salud p\u00fablica o el medio ambiente que son \u00e1reas en las que es deseable defender los bienes p\u00fablicos y no s\u00f3lo los derechos individuales. <\/p>\n<p>Para ilustrar este argumento les traigo aqu\u00ed el caso novedoso de una sentencia estructural decidida en la jurisdicci\u00f3n administrativa. <\/p>\n<p>Hace ya casi 4 a\u00f1os\u2014en septiembre de 2009\u2014un grupo de organizaciones que representan a personas viviendo con VIH-Sida instauraron una acci\u00f3n popular contra el Ministerio de Salud y Protecci\u00f3n Social, la Superintendencia de Industria y Comercio (SIC) y el laboratorio farmac\u00e9utico Abbott Laboratories. Los demandantes sosten\u00edan que los elevados precios de Kaletra \u2013un antirretroviral patentado por Abbott en Colombia desde 2006\u2014eran en Colombia muy superiores a los del resto de pa\u00edses de la regi\u00f3n y vulneraban los intereses colectivos no s\u00f3lo de las personas que viven con la enfermedad sino de todos los colombianos (esto ya que pon\u00edan en riesgo las finanzas del sistema de salud). <\/p>\n<p>Los accionantes afirmaban que la regulaci\u00f3n estatal de precios de medicamentos implementada hasta ese momento hab\u00eda sido inefectiva y que adem\u00e1s Abbott no hab\u00eda respetado el precio m\u00e1ximo de venta fijado por la Comisi\u00f3n Nacional de Precios de Medicamentos (CNPM) en mayo de 2009. Los demandantes pretend\u00edan entonces que se le ordenara a la SIC emitir una licencia obligatoria abierta para que cualquier laboratorio que cumpliera con los est\u00e1ndares de calidad pudiera importar, fabricar y distribuir los componentes activos del Kaletra (Lopinavir+Ritonavir).<\/p>\n<p>En el 2012, tanto en primera como en segunda instancia el juez 37 administrativo de Bogot\u00e1 y el Tribunal Superior Administrativo de Cundinamarca fallaron a favor de los demandantes. Ambos fallos consideraron que el Ministerio de Salud y Protecci\u00f3n Social y la Comisi\u00f3n Nacional de Precios de Medicamentos hab\u00edan efectivamente amenazado y vulnerado los derechos e intereses colectivos a la salubridad p\u00fablica ya que permitieron que los precios internos del Kaletra superaran los precios internacionales. <\/p>\n<p>A pesar de que ninguno de los dos jueces otorgaran la licencia obligatoria que solicitaban los demandantes, s\u00ed conminaron al ejecutivo a implementar \u201clas pol\u00edticas necesarias para regularizar los precios del medicamento en condiciones m\u00e1s favorables para contribuir al sostenimiento del Sistema de Seguridad Social en Salud.\u201d<\/p>\n<p>Tras el fallo de segunda instancia, el juez 37 Administrativo conform\u00f3 un Comit\u00e9 de Verificaci\u00f3n. Adicionalmente, como parte del procedimiento establecido por la Ley que regula las acciones populares y de grupo (Ley 472 de 1998) el juez realiz\u00f3 una audiencia de verificaci\u00f3n de cumplimiento en la que consider\u00f3 que el ejecutivo hab\u00eda incumplido la sentencia. El proceso result\u00f3 en la Circular 06 de 2013 de la CNPM que establece precios m\u00e1ximos de para Kaletra comparables a los de pa\u00edses como Brasil, Chile y Per\u00fa. <\/p>\n<p>A pesar de que Abbott presentara a trav\u00e9s de su apoderado una tutela en contra del juez 37 Administrativo por presunta violaci\u00f3n al derecho al debido proceso, el pasado lunes se ratificaron todas las decisiones en una nueva Audiencia de cumplimiento a la que asisti\u00f3 Abbott (ahora Abbvie).<\/p>\n<p>Esta sentencia, as\u00ed como los fallos del Tribunal Administrativo de Cundinamarca sobre la descontaminaci\u00f3n del Rio Bogot\u00e1 o el del Consejo de Estado que ordena proteger los Cerros Orientales de Bogot\u00e1, son muestras de que los jueces administrativos se le est\u00e1n midiendo a proferir sentencias de reforma estructural que buscan corregir fallas regulatorias del Estado. Esto significa que adem\u00e1s de la Corte Constitucional, tenemos ahora en el Consejo de Estado, en el Tribunal Administrativo de Cundinamarca y en los jueces administrativos a otros defensores del inter\u00e9s p\u00fablico que a trav\u00e9s de sus fallos exhortan al ejecutivo a que tome medidas regulatorias orientadas a proteger derechos individuales y colectivos. <\/p>\n<p>\u00c9sta podr\u00eda ser una evoluci\u00f3n muy saludable de la jurisdicci\u00f3n administrativa nacional.
