{"id":28275,"date":"2013-12-15T00:00:00","date_gmt":"2013-12-15T05:00:00","guid":{"rendered":"https:\/\/www.dejusticia.org\/with-three-articles\/"},"modified":"2017-04-11T08:04:14","modified_gmt":"2017-04-11T13:04:14","slug":"with-three-articles","status":"publish","type":"post","link":"https:\/\/develop.dejusticia.org\/en\/with-three-articles\/","title":{"rendered":"With Three Articles"},"content":{"rendered":"<p>Es posible limitar los mayores riesgos institucionales de la Procuradur\u00eda y los peores excesos personales del Procurador Ord\u00f3\u00f1ez sin necesidad de reformar la Constituci\u00f3n; basta una corta ley de tres art\u00edculos. <\/p>\n<p>La Constituci\u00f3n autoriza (desafortunadamente) que la Procuradur\u00eda ejerza un poder disciplinario preferente sobre todos los servidores p\u00fablicos, incluso aquellos de elecci\u00f3n popular; pero se\u00f1ala que las sanciones deber\u00e1n ser \u201cconforme a la ley\u201d. La ley debe entonces definir las sanciones que puede imponer el procurador.<br \/>\nEl primer art\u00edculo dir\u00eda entonces que la Procuradur\u00eda no puede inhabilitar a ning\u00fan funcionario, pues esa sanci\u00f3n, impuesta por una autoridad no judicial, como la Procuradur\u00eda, viola el art\u00edculo 23 de la Convenci\u00f3n Americana de Derechos Humanos, que establece que esas restricciones a los derechos pol\u00edticos s\u00f3lo las puede ordenar un juez.<br \/>\nEl segundo art\u00edculo reconocer\u00eda que la Procuradur\u00eda puede sancionar disciplinariamente a los funcionarios electos popularmente (pues as\u00ed lo prev\u00e9 la Constituci\u00f3n), pero dir\u00eda que no puede suspenderlos ni destituirlos, pues esas sanciones tienen efectos muy negativos sobre los derechos pol\u00edticos de los ciudadanos que los eligieron y que esperan que cumplan su mandato. El procurador podr\u00eda, por ejemplo, amonestar p\u00fablicamente a un funcionario electo popularmente, pero su destituci\u00f3n o suspensi\u00f3n estar\u00eda reservada a los jueces.<br \/>\nEl tercer art\u00edculo limitar\u00eda el excesivo poder burocr\u00e1tico del procurador, que le facilit\u00f3 su reelecci\u00f3n y que est\u00e1 muy ligado al manejo de los cargos de procurador judicial, que son empleados costosos pero casi in\u00fatiles, pues duplican las tareas de otros funcionarios. El art\u00edculo podr\u00eda reducir la planta de procuradores judiciales de 760 a unos 30 y trasladar a los actuales a otras instituciones, como la Fiscal\u00eda o la Defensor\u00eda P\u00fablica, en donde hacen falta y cumplir\u00edan una labor productiva.<br \/>\nYo prefiero que la Procuradur\u00eda sea eliminada, pues es una instituci\u00f3n costosa, redundante y riesgosa. Pero esta ley, corta y poderosa, eliminar\u00eda sus peores riesgos. Y solucionar\u00eda adem\u00e1s el problema de Petro y de muchos otros funcionarios injustamente sancionados por el procurador, como Alonso Salazar, el exalcalde de Medell\u00edn, ya que tendr\u00eda efectos retroactivos, pues son normas m\u00e1s favorables para los sancionados.<br \/>\nUna ley as\u00ed podr\u00eda adem\u00e1s ser aprobada en dos semanas, si el Gobierno lo quiere. El presidente podr\u00eda convocar a sesiones extraordinarias del Congreso y el proyecto, con mensaje de urgencia, ser\u00eda debatido conjuntamente en las comisiones de las dos c\u00e1maras; las plenarias pueden aprobarlo ocho d\u00edas despu\u00e9s. Ser\u00eda un buen regalo de a\u00f1o nuevo para Colombia.
