{"id":28281,"date":"2013-12-14T00:00:00","date_gmt":"2013-12-14T05:00:00","guid":{"rendered":"https:\/\/www.dejusticia.org\/intimacy-in-the-digital-age\/"},"modified":"2017-04-11T08:04:21","modified_gmt":"2017-04-11T13:04:21","slug":"intimacy-in-the-digital-age","status":"publish","type":"post","link":"https:\/\/develop.dejusticia.org\/en\/intimacy-in-the-digital-age\/","title":{"rendered":"Intimacy in the Digital Age"},"content":{"rendered":"<p>La regla general es que todas las personas tienen derecho a su intimidad, que es una zona abstracta reservada por ley para uno mismo, sus amigos y su familia. La intimidad se puede restringir principalmente en dos casos: a) hacer inteligencia para protegernos de los enemigos concretos o b) perseguir a delincuentes, bajo autorizaci\u00f3n de los jueces.  Estos dos casos son excepcionales, deben ser necesarios y proporcionados y si se convierten en la cotidianidad terminar\u00edan eliminando esa zona personal que queremos proteger de lo p\u00fablico.<\/p>\n<p>Tanto la intimidad como sus excepciones operan en el mundo real y en el mundo digital, pero hay quienes quieren hacernos creer lo contrario. En Naciones Unidas, cinco pa\u00edses que se conocen como los Cinco Ojos por sus acuerdos secretos para chuzar las comunicaciones de los dem\u00e1s, quisieron desarrollar las teor\u00edas de la extraterritorialidad y de la virtualidad para escapar a la regla general que propon\u00edan Brasil y Alemania.<\/p>\n<p>Seg\u00fan su propia versi\u00f3n de la territorialidad, los Estados s\u00f3lo deber\u00edan respetar la intimidad de quienes se encuentran en su territorio y su jurisdicci\u00f3n. As\u00ed justific\u00f3  parcialmente Obama la actuaci\u00f3n de la NSA develada por Snowden.  De manera que, alegando proteger la seguridad interior, un gobierno podr\u00eda entrar legalmente en el mundo privado de qui\u00e9n suministra los servicios de comunicaciones y exigir, sin la autorizaci\u00f3n judicial debida, la revelaci\u00f3n de todos los datos que giran en torno a un usuario con relaciones en el extranjero.  Como si el internet funcionase con aduanas, visas y pasaportes. <\/p>\n<p>Tambi\u00e9n alegaron los Cinco Ojos, liderados por Estados Unidos y sustentados en sus agencias de inteligencia, que en la virtualidad vale menos la intimidad.  Los opositores a los Cinco Ojos contra-argumentaron  y explicaron lo clave del anonimato en internet para circular sin atentar contra la libertad de expresi\u00f3n.  Insistieron que esta protecci\u00f3n es v\u00e1lida en los Estados represivos, donde expresarse en contra del r\u00e9gimen es peligroso (como en la Primavera \u00c1rabe o incluso en ocasiones en Colombia) pero tambi\u00e9n lo es en circunstancias ordinarias. Y a\u00f1adieron que la percepci\u00f3n de ser observado afecta la confianza de la gente y su posibilidad de ser totalmente verdaderos para si mismos, sus amigos, su familia e incide en lo que dicen, a donde van, con qui\u00e9n andan y como interact\u00faan, especialmente cuando los afectados son una minor\u00eda vulnerable o no-dominante o si se trata de periodistas que tienen fuentes reservadas. <\/p>\n<p>Afortunadamente, en estas discusiones que tuvieron lugar en el Comit\u00e9 de Derechos Humanos de Naciones Unidas en el pasado mes de noviembre, lo Cinco Ojos tuvieron que ceder ante la presi\u00f3n de los Estados que hab\u00edan propuesto una resoluci\u00f3n respetuosa al derecho a la intimidad.   As\u00ed que, despu\u00e9s de mucha presi\u00f3n, hubo consenso al aceptar que estas f\u00f3rmulas de vigilancia masiva violan el derecho humano a la intimidad y que la prevenci\u00f3n gen\u00e9rica del terrorismo no es causa suficiente para espiar globalmente.  Y bajo esta mirada se presentar\u00e1 este mes la resoluci\u00f3n El derecho a la Intimidad en la Era Digital, para aprobaci\u00f3n de la Asamblea General de la ONU. Tambi\u00e9n qued\u00f3 claro que hay que seguir en guardia frente a los m\u00faltiples ojos; que las excepciones, son excepciones y que no pueden volverse regla general.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Don&#8217;t let them persuade you that your privacy is worth less on the Internet.
