{"id":28301,"date":"2013-12-31T00:00:00","date_gmt":"2013-12-31T05:00:00","guid":{"rendered":"https:\/\/www.dejusticia.org\/rural-development-that-favor-whom\/"},"modified":"2017-04-11T08:04:51","modified_gmt":"2017-04-11T13:04:51","slug":"rural-development-that-favor-whom","status":"publish","type":"post","link":"https:\/\/develop.dejusticia.org\/en\/rural-development-that-favor-whom\/","title":{"rendered":"Rural Development that Favor Whom?"},"content":{"rendered":"<p>El modelo de desarrollo rural propuesto por el Gobierno Nacional lejos de facilitar la \u201cdemocratizaci\u00f3n\u201d de la tierra promueve la concentraci\u00f3n de su uso en favor de grandes inversionistas.<\/p>\n<p>Despu\u00e9s de tres a\u00f1os de gesti\u00f3n, el Gobierno Nacional ha hecho varios intentos para lograr la aprobaci\u00f3n de un modelo de desarrollo rural que facilita el acaparamiento de tierras con el fin de promover el desarrollo de proyectos agroindustriales a gran escala. Este proyecto parece ir en contra v\u00eda de sus prop\u00f3sitos de buscar la paz y alcanzar una sociedad m\u00e1s democr\u00e1tica, capaz de brindarle al campesinado un lugar digno.<\/p>\n<p>As\u00ed, desde la expedici\u00f3n del Plan Nacional de Desarrollo, se aprobaron tres art\u00edculos que eliminaban las medidas restrictivas de venta de bald\u00edos adjudicados a campesinos y modificaban la disposici\u00f3n de esos terrenos de forma que pudiesen ser adjudicados a empresas agropecuarias sin ninguna limitaci\u00f3n. La Corte Constitucional tumb\u00f3 estas disposiciones por considerarlas regresivas frente al deber del Estado de eliminar y prevenir la inequitativa concentraci\u00f3n de la propiedad rural.<\/p>\n<p>Aun cuando a la fecha no se ha garantizado la \u201cdemocratizaci\u00f3n\u201d y desconcentraci\u00f3n de la tierra, el Gobierno de Santos ha reiterado como uno de los lineamientos de la locomotora del agro \u201cgarantizar la inversi\u00f3n en el campo\u201d. As\u00ed qued\u00f3 claro en el proyecto de ley presentado por el Ministro de Agricultura en el mes pasado, el cual creaba nuevas modalidades de acceso a la propiedad de la tierra y modificaba el r\u00e9gimen de bald\u00edos. <\/p>\n<p>Si bien este proyecto fue retirado por orden del presidente, es importante recordar su contenido a fin de continuar el debate nacional respecto del modelo que se pretende implementar. Al menos tres puntos merecen una particular atenci\u00f3n.<\/p>\n<p>En primer lugar, el art\u00edculo 21 establec\u00eda que las limitaciones y restricciones para la acumulaci\u00f3n de Unidades Agr\u00edcolas Familiares (UAF) s\u00f3lo ser\u00edan aplicables para bienes adjudicados despu\u00e9s del 5 de agosto de 1994. Con este art\u00edculo se intentaba legalizar la compra masiva de bald\u00edos por parte de empresas como Riopaila Castilla S.A., Poligrow, Indupalma, Cementos Argos, M\u00f3nica Semillas, entre otras, que mediante \u201cestrategias sofisticadas\u201d lograron acumular tierras que estaban destinadas a campesinos de escasos recursos y sin tierra.<\/p>\n<p>En segundo lugar, el proyecto reproduc\u00eda el modelo de alianzas productivas, donde los campesinos podr\u00edan transferir los bald\u00edos adjudicados a terceros o gestores. En esta ocasi\u00f3n la novedad se encontraba en que los terceros deb\u00edan dejar al menos un 20% de la tierra al campesino para que este desarrollara actividades productivas, claro est\u00e1 \u201carticuladas\u201d con las del gestor. Estas normas constitu\u00edan claramente un retroceso respecto de la ley 160, que imped\u00eda la acumulaci\u00f3n de bald\u00edos adjudicados en cabeza de grandes propietarios. Si bien con estas alianzas el campesino conserva la propiedad sobre la tierra, en la pr\u00e1ctica no ser\u00eda m\u00e1s que un trabajador o aparcero del tercero.<\/p>\n<p>En tercer lugar, el proyecto promov\u00eda la expansi\u00f3n de zonas de inter\u00e9s para el desarrollo econ\u00f3mico y social, las cuales pod\u00edan ser entregadas directamente en arrendamiento y otras modalidades a empresas para la explotaci\u00f3n de cultivos agr\u00edcolas, actividades forestales o ganader\u00eda. El proyecto no establec\u00eda restricciones claras respecto de plazos, extensiones m\u00e1ximas y condiciones para la explotaci\u00f3n de estos bald\u00edos, circunstancia que abr\u00eda paso al aprovechamiento sin l\u00edmites de estas tierras.<\/p>\n<p>Como se observa hasta aqu\u00ed, el modelo de desarrollo rural propuesto por el gobierno nacional promueve la entrega y concentraci\u00f3n de bald\u00edos para desarrollar proyectos agroindustriales a gran escala, impidiendo el acceso y explotaci\u00f3n de las tierras por parte de los trabajadores agrarios. <\/p>\n<p>A\u00fan cuando estas pol\u00edticas resultan problem\u00e1ticas pues parecen contrarias a algunos puntos del Pacto Agrario y los acuerdos de La Habana, su contenido se ajusta perfectamente a la din\u00e1mica del mercado de tierras internacional que busca resolver los problemas de tenencia de la tierra para dar garant\u00edas y seguridad a grandes inversionistas que est\u00e1n interesados en adquirirlas. <\/p>\n<p>No se trata de hacer lobby mamerto para impedir el \u201cdesarrollo del pa\u00eds\u201d. En el fondo lo que se busca es abrir ampliamente la discusi\u00f3n sobre un modelo de desarrollo rural que promueve la acumulaci\u00f3n de la tierra para darle un uso en actividades destinadas a la producci\u00f3n de alimentos y agrocombustibles para la exportaci\u00f3n.
