{"id":28321,"date":"2014-01-19T00:00:00","date_gmt":"2014-01-19T05:00:00","guid":{"rendered":"https:\/\/www.dejusticia.org\/protections-in-criminal-procedure-and-removal-from-office\/"},"modified":"2017-04-11T08:05:33","modified_gmt":"2017-04-11T13:05:33","slug":"protections-in-criminal-procedure-and-removal-from-office","status":"publish","type":"post","link":"https:\/\/develop.dejusticia.org\/en\/protections-in-criminal-procedure-and-removal-from-office\/","title":{"rendered":"Protections in Criminal Procedure and Removal from Office"},"content":{"rendered":"<p>El art\u00edculo 23 establece que un derecho pol\u00edtico s\u00f3lo puede ser limitado por una \u201ccondena, por juez competente, en proceso penal\u201d. Estos requisitos no son caprichosos: se justifican no s\u00f3lo por la importancia de los derechos pol\u00edticos en una democracia sino, adem\u00e1s, por los riesgos de que las autoridades administrativas persigan a los opositores. Y por eso la CA establece una doble garant\u00eda: que la sanci\u00f3n provenga de i) un juez, por ser una autoridad independiente e imparcial, y que sea consecuencia de ii) un proceso penal, pues es el que ofrece mayores garant\u00edas para el eventual sancionado.<\/p>\n<p>La destituci\u00f3n de un funcionario electo es una restricci\u00f3n de los derechos pol\u00edticos del elegido (que no puede culminar su per\u00edodo) y de sus electores (que se ven privados de su mandatario). Una conclusi\u00f3n se impone: el procurador, como no es juez, no debe poder destituir a un funcionario electo, pues eso es antidemocr\u00e1tico y viola el art\u00edculo 23 de la CA. Pero la ley colombiana autoriza al procurador a imponer esas sanciones y, en una desafortunada sentencia, la Corte Constitucional aval\u00f3 esa facultad. Es necesario que la Corte cambie su jurisprudencia o que la ley sea reformada, pero mientras, en Colombia, hay argumentos para sostener que el procurador puede destituir alcaldes.<\/p>\n<p>En gracia de discusi\u00f3n, supongamos entonces que el procurador tiene hoy esa facultad. Pero esa conclusi\u00f3n no excluye la segunda garant\u00eda del art\u00edculo 23 de la CA y es que la sanci\u00f3n debe ser consecuencia de un \u201cproceso penal\u201d. Por eso, a pesar de que el proceso adelantado por el procurador sea administrativo, si va a destituir un alcalde, el procurador debe cumplir con las garant\u00edas propias del proceso penal, a fin de armonizar su facultad sancionatoria con las exigencias del art\u00edculo 23 de la CA.<br \/>\nEn esos casos, no basta el debido proceso administrativo sino que el procurador debe respetar el debido proceso penal. Y esto tiene consecuencias trascendentales pues, como lo desarrollo m\u00e1s extensamente en nuestro blog en La Silla Vac\u00eda, el proceso penal es mucho m\u00e1s exigente. <\/p>\n<p>Por tocar s\u00f3lo un punto: una falta administrativa puede estar descrita en forma abierta y gen\u00e9rica, pero un delito requiere una descripci\u00f3n precisa. Y como el procurador debe respetar el debido proceso penal, s\u00f3lo puede destituir alcaldes si los sanciona con base en faltas administrativas que tengan la precisi\u00f3n y descripci\u00f3n propias de un delito.<\/p>\n<p>Eso no sucedi\u00f3 en la sanci\u00f3n a Petro pues las tres faltas grav\u00edsimas que el procurador le imputa son extremadamente abiertas, por lo que son incompatibles con las garant\u00edas propias del proceso penal, que rigen en este caso.
