Estos son los principales:<\/p>\n<p><strong>1. \u00bfHasta d\u00f3nde va el trato especial con la fuerza p\u00fablica?<\/strong><\/p>\n<p>Seg\u00fan el acuerdo final, la Jurisdicci\u00f3n Especial para la Paz (JEP) utilizar\u00e1 fuentes como el C\u00f3digo Penal colombiano y las normas de derechos humanos (DIDH), el Derecho Internacional Humanitario (DIH) y el Derecho Penal Internacional (DPI), para determinar la sanci\u00f3n de las personas que se hayan visto envueltas en hechos relacionados con el conflicto armado.<\/p>\n<p>Sin embargo, en este Proyecto de Acto Legislativo se est\u00e1 creando una regla particular para la fuerza p\u00fablica, sin raz\u00f3n alguna. Por un lado, en estos casos se omitir\u00e1 lo dicho por el Derecho Penal Internacional y las normas de derechos humanos y, por el otro, se tendr\u00e1 en cuenta el C\u00f3digo Penal colombiano pero aquel que estaba \u201cvigente al momento de la comisi\u00f3n del hecho\u201d. &nbsp;<\/p>\n<p>No existe justificaci\u00f3n para que esto sea as\u00ed. Primero: porque Colombia &nbsp;ha reconocido los tratados de Derecho Penal Internacional (como el Estatuto de la Corte Penal Internacional) que aplican a todos los responsables de cometer cr\u00edmenes internacionales (genocidio, cr\u00edmenes de lesa humanidad y de guerra). Y segundo: porque si al momento de ocurrir el crimen \u00e9ste no estaba calificado como tal en la legislaci\u00f3n penal colombiana, podr\u00edan quedar por fuera hechos que actualmente el Estado tiene la obligaci\u00f3n de juzgar y sancionar seg\u00fan el DIDH y el DIH, como el genocidio o la desaparici\u00f3n forzada.<\/p>\n<p><strong>2. \u00bfJusticia especial para cr\u00edmenes por fuera del conflicto?<\/strong><\/p>\n<p>El acuerdo fija unos principios m\u00ednimos para juzgar a los perpetradores: que se sancione a todos los responsables del conflicto con unas reglas similares y un tratamiento equilibrado.&nbsp;<\/p>\n<p>Pero este proyecto de acto legislativo tiene dos raseros distintos para excombatientes de la guerrilla y la fuerza p\u00fablica. Para estos \u00faltimos, la Jurisdicci\u00f3n Especial para la Paz no s\u00f3lo tendr\u00e1 competencia para juzgar sus actos relacionados con el conflicto armado, sino que podr\u00e1 tratar otro tipo de conductas que no tienen una relaci\u00f3n muy clara con el conflicto.<\/p>\n<p>En otras palabras, los miembros de la fuerza p\u00fablica podr\u00e1n acceder al tratamiento especial de la JEP (en lugar de hacerlo a trav\u00e9s de la justicia ordinaria, que es m\u00e1s severa), para que se juzguen otros delitos como aquellos en los que exist\u00eda \u00e1nimo de obtener enriquecimiento personal, o aquellos cometidos por una persona que, por haber pertenecido a la fuerza p\u00fablica, adquiri\u00f3 mayores habilidades al haber participado en el conflicto armado. Por ejemplo, se podr\u00edan ver beneficiados por esto los militares que se vieron envueltos en grupos delincuenciales donde desplegaron acciones armadas o, incluso, espionajes como la operaci\u00f3n Andr\u00f3meda, en la que miembros de la fuerza p\u00fablica utilizaron su conocimiento en inteligencia propia de la guerra para ponerlo a disposici\u00f3n de la persecuci\u00f3n pol\u00edtica.<\/p>\n<p><strong>3. Responsabilidad de mando, en contrav\u00eda del Derecho Internacional Humanitario y Derecho Penal Internacional<\/strong><\/p>\n<p>La responsabilidad del mando es una figura del derecho internacional que permite judicializar a un comandante militar por las atrocidades cometidas por sus subalternos. Claro, bajo unos requisitos. La regla general es que si el comandante no orden\u00f3 ni particip\u00f3 en esos actos debe responder por ellos si, pudiendo hacerlo, no evit\u00f3 que \u00e9stos ocurrieran o se abstuvo de sancionar a los responsables. En este tema hay varios reparos:<\/p>\n<p>Primero: en este proyecto no est\u00e1 expl\u00edcito que la responsabilidad del mando tambi\u00e9n aplicar\u00e1 a los jefes guerrilleros, como lo establece el acuerdo final. &nbsp;Este vac\u00edo ha llevado a que algunos infieran que s\u00f3lo aplicar\u00e1 a la fuerza p\u00fablica y no a la guerrilla. Por esto, es fundamental que se incluya este punto expl\u00edcitamente.<\/p>\n<p>Segundo: el proyecto contiene una cl\u00e1usula expl\u00edcita de responsabilidad para mandos policiales y militares, pero no para otros agentes del Estado, como gobernadores o alcaldes, que son la m\u00e1xima autoridad de polic\u00eda en sus jurisdicciones.<\/p>\n<p>Tercero: seg\u00fan este proyecto solamente existe mando y control efectivo si hay una relaci\u00f3n de subordinaci\u00f3n, \u201cde tipo jur\u00eddica y de facto\u201d, entre el superior y quien cometi\u00f3 el crimen. La exigencia de esos requisitos formales y materiales para comprobar la responsabilidad del mando, desconoce el Derecho Penal Internacional. Seg\u00fan este, la existencia de mando efectivo sobre las tropas se determina probatoriamente, estableciendo si el superior pod\u00eda o no prevenir la atrocidad cometida por sus subalternos.&nbsp;<\/p>\n<p>Si esto no cambia, es improbable que en Colombia se llegue a condenas efectivas a los m\u00e1ximos responsables de las atrocidades que ha vivido el pa\u00eds en el \u00faltimo medio siglo. Y ser\u00e1 dif\u00edcil que se d\u00e9 una condena como la que la Corte Penal Internacional le impuso en junio del 2016 a Jean-Pierre Bemba, exvicepresidente de la Rep\u00fablica Democr\u00e1tica del Congo. Bemba fue encontrado culpable porque las tropas del Movimiento para la Liberaci\u00f3n del Congo, que estaban bajo su mando, cometieron cr\u00edmenes de guerra y de lesa humanidad en el pa\u00eds vecino: la Rep\u00fablica Centroafricana. Aunque \u00e9l no ten\u00eda mando legal sobre la Rep\u00fablica Centroafricana, s\u00ed ten\u00eda mando material sobre las tropas que operaban all\u00ed.&nbsp;<\/p>\n<p>O el Tribunal Penal Internacional para la ex Yugoslavia no hubiese podido condenar a Zdravko Mucic por su responsabilidad de mando, sobre los cr\u00edmenes que cometieron sus subordinados en la prisi\u00f3n Celebici (usada durante la guerra de Bosnia de 1992 para recluir ilegalmente a prisioneros serbios). Mucic no recibi\u00f3 nombramiento formal como comandante de la prisi\u00f3n. Pero el Tribunal encontr\u00f3 que ten\u00eda control de hecho sobre sus subordinados. Por ejemplo, un periodista bosnio asegur\u00f3 que hab\u00eda ingresado a esta prisi\u00f3n con un permiso de Mucic.&nbsp;<\/p>\n<p>Cuarto: este proyecto solamente exige que se juzgue a un superior, si se prueba que este sab\u00eda que sus subordinados estaban cometiendo o iban a cometer un crimen. Pero el Derecho Internacional Humanitario y el Derecho Penal Internacional tambi\u00e9n exigen que se juzgue a superiores si hay evidencia de que estos pose\u00edan informaci\u00f3n que les \u201cpermitiera concluir, en las circunstancias del momento, que sus subordinados estaban cometiendo o iban a cometer violaciones\u201d.&nbsp;<\/p>\n<p>As\u00ed ocurri\u00f3 en el mencionado caso de Mucic. El tribunal de la ex Yugoslavia argument\u00f3 que este comandante supo o ten\u00eda razones para saber que sus subordinados estaban cometiendo cr\u00edmenes en Celebici. Los cr\u00edmenes ocurridos all\u00ed fueron tan frecuentes y notorios que no hab\u00eda manera de que no supiera o escuchara de ellos.<\/p>\n<p><strong>4. La Unidad para la b\u00fasqueda de desaparecidos, amarrada al ejecutivo<\/strong><\/p>\n<p>Seg\u00fan este proyecto, la Unidad para la b\u00fasqueda de personas dadas por desaparecidas en el contexto y en raz\u00f3n del conflicto (UBPD) podr\u00eda depender de la rama ejecutiva.<\/p>\n<p>Esta unidad necesita autonom\u00eda e independencia frente a las ramas del poder p\u00fablico, para actuar sin restricciones. Por ejemplo, ello es clave en casos de desapariciones en los que est\u00e9n involucrados agentes del Estado. Adem\u00e1s, es esencial que esta unidad sea percibida por todas las v\u00edctimas como una entidad imparcial en la que puedan confiar.<\/p>\n<p><strong>5. El riesgo de que colapse la Jurisdicci\u00f3n Especial para la Paz<\/strong><\/p>\n<p>El acuerdo final contempla que la JEP debe concentrarse, desde el principio, en investigar, juzgar y sancionar a quienes tuvieron una participaci\u00f3n determinante en los cr\u00edmenes m\u00e1s graves y representativos.<\/p>\n<p>Sin embargo, este proyecto de acto legislativo introdujo un nuevo art\u00edculo que puede generar confusiones &nbsp;sobre la competencia de la JEP (el art\u00edculo 16 transitorio). Este se refiere a los terceros que participaron directa o indirectamente en el conflicto armado contribuyendo, por ejemplo, a su financiaci\u00f3n. Tal y como est\u00e1 redactado, da la sensaci\u00f3n de que s\u00f3lo se priorizar\u00e1n y seleccionar\u00e1n los casos de esos terceros y no de aquellos que involucran a miembros de la guerrilla o agentes del estado.<\/p>\n<p>Por esto, un grupo de organizaciones y universidades propusimos la inclusi\u00f3n de un nuevo art\u00edculo para que quede expl\u00edcito que la JEP se concentrar\u00e1 en los casos m\u00e1s graves y representativos, sin importar el tipo de actor que los perpetr\u00f3.<\/p>\n<p>Nota: Aqu\u00ed puede encontrar <a href=\"https:\/\/develop.dejusticia.org\/en\/\/#!\/actividad\/3406\" data-mce-href=\"..\/#!\/actividad\/3406\">el comunicado<\/a>&nbsp;con estas propuestas firmado por Dejusticia, la Comisi\u00f3n Colombiana de Juristas, la Misi\u00f3n de Observaci\u00f3n Electoral, acad\u00e9micos de las universidades Nacional de Colombia, del Rosario y de los Andes, y el Fondo de Capital Humano para la Transici\u00f3n en Colombia del Institute for Integrated Transitions&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The House of Representatives has already approved the constitutional reform that creates the Special Peace Jurisdiction (JEP) and regulates the special treatment to the public force.
