La sentencia es positiva porque nuevamente reconoce que los alcaldes y concejos municipales pueden pronunciarse sobre las actividades mineras para ordenar su territorio y proteger el medio ambiente. Debe recordarse que buena parte de los argumentos de quienes interpusieron la tutela y luego apelaron la decisi\u00f3n de primera instancia giraban en torno a la cuesti\u00f3n de la competencia del municipio para tomar estas decisiones. Por eso es positivo e importante que el Consejo de Estado haya reiterado que los municipios S\u00cd pueden pronunciarse sobre las actividades mineras. Espec\u00edficamente, lo que dice la sentencia al respecto es:<\/p>\n

\u201clos entes territoriales tienen competencia para ordenar el territorio y para reglamentar los usos del suelo, ejercida a trav\u00e9s de las autoridades locales, esto es el Concejo y el alcalde, lo que permite adoptar normas y medidas sobre las actividades que puedan desarrollarse en el territorio del municipio, como ocurre con el uso del suelo y la miner\u00eda; por tanto, las consultas populares sobre proyectos y actividades de miner\u00eda se encuentran en el marco de la competencia de las entidades territoriales, por tanto el alcalde puede promover la iniciativa<\/p>\n

La decisi\u00f3n del Consejo de Estado es positiva pues reafirma que la alcald\u00eda tiene competencia para convocar una consulta popular sobre actividades mineras. Dado que le orden\u00f3 al Tribunal expida otra sentencia, ahora hay que esperar a que el Tribunal Administrativo del Tolima se pronuncie nuevamente sobre la pregunta. Lo m\u00e1s probable es que el Tribunal considere que la pregunta debe ser modificada, pero esto no necesariamente significa que la consulta se caiga. El Tribunal puede ordenarle al Alcalde o al Concejo Municipal (que son quienes legalmente tienen competencia para hacerlo) que modifiquen la pregunta para que no induzca hacia una respuesta.<\/p>\n

Por ende, si bien es probable que se deban repetir algunas instancia del proceso que se ven\u00eda adelantando, la consulta sigue en pie y su legalidad y constitucionalidad ya no est\u00e1n en discusi\u00f3n. En s\u00edntesis: hay que esperar a que el Tribunal revise la pregunta y decida si quien tiene que proponer otra es el Alcalde o el Concejo Municipal.<\/p>\n
