Dicha creaci\u00f3n es posible en la Constituci\u00f3n, ya que \u00e9sta permite que la funci\u00f3n jurisdiccional sea ejercida por jurisdicciones distintas a la ordinaria. Eso explica, por ejemplo, que la Constituci\u00f3n reconoce la jurisdicci\u00f3n especial ind\u00edgena, de paz o la militar.&nbsp;<\/p>\n<p>De otro lado, el texto resalta la relevancia de que el proyecto de reforma constitucional incluya las reglas generales del tratamiento especial a la Fuerza P\u00fablica. En efecto, el Acuerdo Final busca darle un cierre global al conflicto, lo cual implica que se regulen las obligaciones para con las v\u00edctimas de todos los posibles responsables de graves cr\u00edmenes cometidos en el conflicto armado. Sin embargo, dicha regulaci\u00f3n no cumple del todo los deberes internacionales del Estado. En particular, la responsabilidad del mando enfrenta tres problemas: 1) no incluye una regulaci\u00f3n espec\u00edfica para mandos guerrilleros; 2) no regula el caso de responsabilidad del mando de civiles, como ser\u00eda el caso de un Ministro de Defensa, o de alcaldes o gobernadores; y 3) la reglamentaci\u00f3n que contiene del control efectivo y conocimiento del superior no cumple con los est\u00e1ndares fijados por el Derecho Internacional Humanitario ni por el Derecho Penal Internacional.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On February 14, Rodrigo Uprimny participated in the hearing convened by the First Committee of the Senate to discuss the constitutional reform project that creates the Special Jurisdiction for Peace (JEP) and regulates the special treatment of the Public Force.
