{"id":33757,"date":"2017-03-09T00:00:00","date_gmt":"2017-03-09T05:00:00","guid":{"rendered":"https:\/\/www.dejusticia.org\/new-study-shows-growth-in-the-number-of-prisoners-in-latin-america-for-low-level-drug-offenses\/"},"modified":"2017-03-09T00:00:00","modified_gmt":"2017-03-09T05:00:00","slug":"new-study-shows-growth-in-the-number-of-prisoners-in-latin-america-for-low-level-drug-offenses","status":"publish","type":"post","link":"https:\/\/develop.dejusticia.org\/en\/new-study-shows-growth-in-the-number-of-prisoners-in-latin-america-for-low-level-drug-offenses\/","title":{"rendered":"New study shows growth in the number of prisoners in Latin America for low-level drug offenses"},"content":{"rendered":"<p>El informe del CEDD, <a href=\"http:\/\/www.drogasyderecho.org\/index.php\/es\/\" data-mce-href=\"http:\/\/www.drogasyderecho.org\/index.php\/es\/\">Castigos Irracionales: Leyes de Drogas y Encarcelamiento en Am\u00e9rica Latina,<\/a>&nbsp;incluye investigaciones en diez pa\u00edses: Argentina, Bolivia, Brasil, Colombia, Costa Rica, Ecuador, Estados Unidos, M\u00e9xico, Per\u00fa, y Uruguay.<\/p>\n<p>En todos los pa\u00edses latinoamericanos estudiados, con la excepci\u00f3n de Bolivia, la poblaci\u00f3n encarcelada por drogas aument\u00f3 m\u00e1s r\u00e1pido que la poblaci\u00f3n carcelaria en general, a un ritmo de entre 8 y 33 veces en los \u00faltimos 15 a\u00f1os, con variaciones dependiendo del pa\u00eds. En Brasil, mientras la poblaci\u00f3n carcelaria increment\u00f3 en 55% entre 2006 y 2014, la encarcelada por delitos de drogas creci\u00f3 267%, es decir, a un ritmo cinco veces mayor. En Colombia, entre 2000 y 2015, la poblaci\u00f3n carcelaria creci\u00f3 141%, pero la poblaci\u00f3n encarcelada por delitos de drogas aument\u00f3 289%.<\/p>\n<p>\u201cLas c\u00e1rceles se han convertido en la primer respuesta al tema de las drogas, en vez de abordar la situaci\u00f3n desde un punto de vista social, educativo y de salud\u201d, dijo Catalina P\u00e9rez Correa, coordinadora del CEDD y co-autora del estudio. \u201cLos encarcelados no son los grandes traficantes que est\u00e1n atr\u00e1s de la corrupci\u00f3n y violencia que acecha a nuestros pa\u00edses, sino en su gran mayor\u00eda gente pobre con un rol insignificante en el tr\u00e1fico y consumidores, y muchas veces por sustancias como el cannabis\u201d.<\/p>\n<p>En M\u00e9xico en 2012, 62% de las personas internas en centros penitenciarios federales lo estaban por delitos de drogas. De \u00e9stas, el 58.7% fueron sentenciadas por un delito relacionando al cannabis y 38.5% por el delito de posesi\u00f3n. Seg\u00fan la investigaci\u00f3n, 10.2% de la poblacion en las carceles federales en ese entonces estaba sentenciada solamente por conductas relacionadas con \u201ctraer consigo\u201d marihuana. En M\u00e9xico el conusmo est\u00e1 despenalizado y se permite la portaci\u00f3n de drogas para el consumo personal, lo que implica que est\u00e1s personas est\u00e1n encarceladas injustamente. A nivel estatal, adem\u00e1s, uno de cada diez personas en la c\u00e1rcel lo est\u00e1 por delitos contra la salud, y, como muestra la investigaci\u00f3n, hay una tendencia a la alta.<\/p>\n<p>Con respecto a las otras caracter\u00edsticas de los encarcelados por delitos de drogas, en su mayor\u00eda se trata de personas con escasa educaci\u00f3n, en condici\u00f3n de pobreza o con trabajos de baja remuneraci\u00f3n.<\/p>\n<p>Asimismo, la cantidad de mujeres encarceladas por drogas est\u00e1 aumentando a un ritmo m\u00e1s r\u00e1pido que los hombres, trat\u00e1ndose en la mayor\u00eda de los casos de madres solteras.<\/p>\n<p>Un estudio en 2012 en Argentina mostr\u00f3 que 80.5% de las mujeres encarceladas por delitos de drogas afirm\u00f3 ser la principal fuente de sustento en su hogar. En el caso de Colombia, entre 2010 y 2014, el 93% de las mujeres encarceladas por drogas ten\u00edan hijos, mientras el 52.8% eran madres solteras. En todos los pa\u00edses estudiados, el encarcelamiento de estas mujeres puede tener consecuencias devastadoras para sus hijos y familias, y por lo tanto para la sociedad en general pues se crea un c\u00edrculo vicioso de pobreza que empuja a las personas al consumo o tr\u00e1fico de drogas.<\/p>\n<p>El estudio tambi\u00e9n destaca que un importante n\u00famero de los y las encarcelados por delitos de drogas nunca antes hab\u00eda cometido delitos. Por lo general, los encarcelados ocupan los eslabones m\u00e1s bajos de la cadena de las drogas il\u00edcitas o son consumidores encarcelados equivocadamente por microtrafico. El encarcelamiento de estas personas no tiene ning\u00fan impacto en los mercados de drogas, debido a que son las personas m\u00e1s f\u00e1cilmente reemplazadas. Sin embargo, estas personas tienden a ser el blanco principal de los esfuerzos de la aplicaci\u00f3n de la ley, pues es m\u00e1s f\u00e1cil perseguirlos a ellos que a los grandes traficantes. En Costa Rica, por ejemplo, s\u00f3lo en 3.9% de los encarcelados es alg\u00fan l\u00edder o jefe de una organizaci\u00f3n dedicada a la venta de drogas.<\/p>\n<p>Seg\u00fan Sergio Chaparro, investigador de Dejusticia y co-autor del estudio, \u201cEs necesario repensar el uso del derecho penal y de la c\u00e1rcel en la pol\u00edtica de drogas. Es prioritario y necesario sustituir la repuesta penal por un enfoque m\u00e1s amplio que incluya un desarrollo social y de salud p\u00fablica, y que permita avanzar hacia repuestas m\u00e1s humanas y efectivas frente a la creciente vinculaci\u00f3n de las personas con los mercados ilegales de drogas\u201d.<\/p>\n<p>El informe ofrece una seria de recomendaciones de reformas a las pol\u00edticas p\u00fablicas para lograr esta reorientaci\u00f3n en las pol\u00edticas de drogas.<\/p>\n<p>Seg\u00fan Coletta Youngers, Asesora Principal en WOLA y co-autora de la investigaci\u00f3n, \u201cEs ir\u00f3nico que en los Estados Unidos el 20 por ciento de los ciudadanos vive en estados que ya han legalizado o est\u00e1n por legalizar el uso recreacional del cannabis, y mientras tanto el gobierno de M\u00e9xico sigue gastando recursos escasos en encarcelar a consumidores de marihuana\u201d.<\/p>\n<p>El CEDD busca generar informaci\u00f3n sobre las caracter\u00edsticas y los costos, sean sociales o econ\u00f3micos, de las pol\u00edticas en materia de drogas en Am\u00e9rica Latina.
