{"id":37421,"date":"2017-04-20T16:53:20","date_gmt":"2017-04-20T21:53:20","guid":{"rendered":"https:\/\/www.dejusticia.org\/?p=37421\/"},"modified":"2017-05-05T10:10:23","modified_gmt":"2017-05-05T15:10:23","slug":"dejusticia-weighs-in-on-the-ministry-of-justices-proposal-regarding-differentiated-penal-treatment","status":"publish","type":"post","link":"https:\/\/develop.dejusticia.org\/en\/dejusticia-weighs-in-on-the-ministry-of-justices-proposal-regarding-differentiated-penal-treatment\/","title":{"rendered":"Dejusticia weighs in on the Ministry of Justice\u00b4s proposal regarding differentiated penal treatment"},"content":{"rendered":"<p class=\"p1\">With the purpose of strengthening the proposal on the Differential Criminal Treatment for individuals\u00a0associated with the cultivation of illicit crops and women linked to small-scale drug trafficking, we offer some\u00a0comments on the draft bill introduced\u00a0by the Transitional Justice Department at the Ministry of Justice and Law.<\/p>\n<p class=\"p1\"><span class=\"s1\">En el documento nos referimos espec\u00edficamente al TPD denominado como de \u201ctransici\u00f3n\u201d, al TPD \u201ca futuro\u201d y el TPD a mujeres que contiene la propuesta socializada, aqu\u00ed analizamos algunos puntos como la falta de especifidad en los criterios y una referencia diferenciada a menores de edad, a mujeres o poblaciones flotantes en territorios cocaleros. De la misma manera aportamos propuestas.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">As\u00ed mismo, es alarmante que el <strong>TPD a mujeres<\/strong> haya sido trasladado al <strong>Proyecto de Ley 148 \u201cFortalecimiento de la Pol\u00edtica Criminal y Penitenciaria en Colombia\u201d<\/strong>, que ser\u00e1 tramitado via ordinaria en el Congreso.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Consideramos que este proyecto de ley debido a su relaci\u00f3n con la implementaci\u00f3n del Acuerdo Final para la Paz debe ser debatido de manera necesaria v\u00eda fast-track.\u00a0<\/span><span class=\"s1\">La v\u00eda que hoy plantean para presentarlo por tr\u00e1mite ordinario, y como parte de un gran proyecto de ley, reviste un n\u00famero de riesgos. Para mencionar algunos, env\u00eda un mensaje pol\u00edtico contrario al esp\u00edritu de la paz, al no dar car\u00e1cter de urgencia a las medidas del Acuerdo, y particularmente a aquellas que se refieren al enfoque de g\u00e9nero. Por otra parte, surtir\u00eda un proceso mucho m\u00e1s largo, que puede no ser exitoso en lo que concierne a las mujeres encarceladas por delitos de drogas.<\/span><\/p>\n<p class=\"p1\"><a
