The National Comprehensive Program for Crop Substitution (PNIS) is an indispensable tool in overcoming the structural causes that lead families to join the economy of illicit crops. Given the importance of this strategy to solve the problem of illicit drugs, as one of the factors that has crossed, fed and financed the conflict, the President of the Republic created this program through Decree-Law 896 of 2017. In doing so, he fulfilled the formal and material requirements established in several sentences of the Constitutional Court for using presidential powers for peace.<\/p>\n

No obstante, el equipo de Dejusticia consider\u00f3 que la expresi\u00f3n \u201cy que no hayan realizado siembras posteriores al 10 de julio de 2016\u201d, del art\u00edculo 6 del decreto, deb\u00eda ser declarada inexequible por la Corte por cuanto la temporalidad de esta medida es desproporcional. Esto fija un criterio de exclusi\u00f3n basado en una fecha en la que incluso no estaba vigente el acuerdo de paz, y que tiene como consecuencia la discriminaci\u00f3n injustificada de un universo de campesinos en situaci\u00f3n de pobreza y marginalidad.<\/p>\n

Adicionalmente, la intervenci\u00f3n sostiene que aunque el decreto ley es constitucional, su implementaci\u00f3n en los territorios ind\u00edgenas y afrodescendientes deber\u00e1 estar suspendida hasta que el Gobierno Nacional expida una norma espec\u00edfica, que regule los derechos de los pueblos \u00e9tnicos frente a los programas de sustituci\u00f3n de los cultivos de uso il\u00edcito.<\/p>\n","protected":false},"excerpt":{"rendered":"
