Counter-narcotics strategies exploited the selectivity of criminal law to turn drug policy into a war against the weakest: against those who perform logistical tasks in the drug trade (such as human mail or small-scale retailers), who are replaceable game pieces and receive low pay. The question that arises is: why persist on a policy that causes massive incarceration, particularly affecting those who have life experiences shaped by educational or labor marginalization and that has caused irreparable damage to women, men and young people?<\/p>\n

La respuesta a esta pregunta no es f\u00e1cil, pues el problema del narcotr\u00e1fico no es menor y la sociedad ha experimentado el terror gracias a grupos criminales financiados y sus dineros ilegales. Sin embargo, los vaivenes de los discursos populistas llevaron al pa\u00eds por una peligrosa adicci\u00f3n punitiva que increment\u00f3 las penas de todos los delitos de drogas (tendencia que tambi\u00e9n se present\u00f3 para una gran cantidad de conductas) y equipar\u00f3 a los peces grandes con los peque\u00f1os, como si la se\u00f1ora que vende peque\u00f1as cantidades de droga para mantener a su familia estuviera en la misma posici\u00f3n que Pablo Escobar. La respuesta penal no funcion\u00f3 para acabar de ra\u00edz con los carteles, pero la decisi\u00f3n insensata ha sido incrementar las penas. Hoy sabemos que apresar a la gente no sirvi\u00f3 para evitar que el negocio del microtr\u00e1fico moviera alrededor de $6 billones: el triple del presupuesto anual de la Universidad Nacional.\u00a0(Vea aqu\u00ed m\u00e1s cifras sobre la pol\u00edtica de drogas en las c\u00e1rceles)<\/a><\/p>\n

Las cifras de capturas y judicializaciones muestran este sesgo de la pol\u00edtica de drogas. En el informe \u201cDelitos de drogas y sobredosis carcelaria en Colombia\u201d, de Dejusticia y el Colectivo de Estudios, Drogas y Derecho (CEDD), que se lanz\u00f3 el pasado viernes 14 de julio, se document\u00f3 que en nombre de valores altruistas como la salud y el bienestar, en el pa\u00eds fueron capturada entre el 2005 y el 2014 nueve personas cada hora por conductas relacionadas con el porte o el tr\u00e1fico, es decir, m\u00e1s de 727 mil personas, lo que equivale a un 29 % del total de capturas realizadas por la Polic\u00eda. Mientras que los porcentajes por el lavado de activos o el concierto para delinquir, actividades t\u00edpicas de una persona que tiene peso en el negocio de la droga, representaron apenas un 0,5 y 0,7 %, respectivamente.<\/p>\n

Es m\u00e1s f\u00e1cil capturar a quien porta la sustancia que a quienes cometen cr\u00edmenes financieros, pues esto los acerca al dinero, que es m\u00e1s dif\u00edcil de perseguir. De esta manera, no sorprende que el 95 % de las capturas que realiz\u00f3 la Polic\u00eda entre el 2005 y el 2014 por delitos de drogas hayan sido en flagrancia contra personas que transportaban droga, es decir, sin una investigaci\u00f3n judicial previa.<\/p>\n

Se podr\u00edan desestimar estas cifras argumentando que no todas estas personas llegan a ser judicializadas, y eso podr\u00eda ser cierto, pues la judicializaci\u00f3n depende de jueces y fiscales, no de la Polic\u00eda. No obstante, el sistema penal es bastante eficiente para procesar los casos de estupefacientes, lo cual se ve reflejado en la proporci\u00f3n de aumento de la poblaci\u00f3n presa por drogas entre 2000 y 2015: la poblaci\u00f3n penitenciaria aument\u00f3 141 % y la poblaci\u00f3n encarcelada por delitos de drogas aument\u00f3 289 %. Para el a\u00f1o 2015 hab\u00eda cerca de 24 mil personas en las c\u00e1rceles del pa\u00eds por este delito, de las cuales s\u00f3lo el 7 % estaban procesadas o condenadas por otras conductas, como el lavado de activos, concierto para delinquir o testaferrato.<\/p>\n

Si bien no hay cifras desagregadas sobre el perfil educativo y laboral de las personas presas por conductas contra la salud p\u00fablica, la informaci\u00f3n disponible indica que el 79,3 % de las personas privadas de la libertad en general no concluyeron su educaci\u00f3n media y el 42 % hab\u00eda estudiado m\u00e1ximo hasta la primaria. Adem\u00e1s, de una muestra de expedientes de personas condenadas por tr\u00e1fico de estupefacientes, analizada por el Ministerio de Justicia, se encontr\u00f3 que s\u00f3lo el 4 % se dedicaba a un oficio en el que ejerc\u00eda una carrera profesional o estaba estudiando, mientras que la gran mayor\u00eda (61,7 %) se dedicaba a labores informales.<\/p>\n

El uso de la prisi\u00f3n en Colombia se sali\u00f3 de proporci\u00f3n. Si la idea era controlar la producci\u00f3n, transporte y uso de drogas a partir de la mano dura, con el tiempo se termin\u00f3 criminalizando ciertas formas de vulnerabilidad y marginalizaci\u00f3n, con el agravante de que el problema de fondo no se ha solucionado. Montar esta locura de guerra contra las drogas fue f\u00e1cil en comparaci\u00f3n con todo lo que nos toca hacer para declararles la paz a las personas que las usan, las producen o las transportan. No me refiero a perdonar los cr\u00edmenes del narcotr\u00e1fico, sino a darle la vuelta a la estrategia y entender que encarcelando a la gente que sobrevive con las migajas de ese negocio, no se va a solucionar el problema de las drogas.<\/p>\n","protected":false},"excerpt":{"rendered":"
