During times of political transition from war to peace, constitutionalism must be sensitive to the political context, so that it facilitates the profound transformations that society requires to make peace a reality. This is something that our Political Constitution allows, which is why the Constitutional Court must deliver a balanced constitutional assessment of the legislative acts that reform the Constitution in order to implement the Final Peace Agreement.<\/p>\n

El pasado mi\u00e9rcoles 4 de julio la Corte Constitucional convoc\u00f3 a una audiencia p\u00fablica, dentro del control autom\u00e1tico de constitucionalidad al Acto Legislativo 1 de 2017 que cre\u00f3 el Sistema Integral de Verdad, Justicia, Reparaci\u00f3n y Garant\u00edas de no Repetici\u00f3n, del cual hace parte la Jurisdicci\u00f3n Especial para la Paz (JEP). Rodrigo Uprimny fue invitado a participar en el eje tem\u00e1tico sobre la naturaleza, el alcance y el tipo de control de constitucionalidad que la Corte debe ejercer sobre las reformas constitucionales encaminadas a implementar el Acuerdo Final de Paz.<\/p>\n

En su intervenci\u00f3n, Uprimny defendi\u00f3 que Colombia est\u00e1 atravesando un \u00a0momento constitucional especial, a partir de cuatro tesis: 1. El caso colombiano parece no tener un referente en otros procesos transicionales. 2. La Constituci\u00f3n Pol\u00edtica de 1991 est\u00e1 abierta a la paz y a las transformaciones institucionales requeridas para hacer viable la transici\u00f3n. 3. El momento transicional actual marca el cierre de un proceso constitucional iniciado con la Constituyente de 1991. 4. Estas caracter\u00edsticas influyen en el tipo de control constitucional que debe realizar la Corte.<\/p>\n

Rodrigo Uprimny plante\u00f3 entonces que la Corte deber\u00eda realizar un juicio de sustituci\u00f3n \u201cdoblemente ponderado\u201d, lo cual significa que el tribunal debe ser precavido para que sus fallos no impidan, sino que por el contrario faciliten, las\u00a0 profundas transformaciones que requieren los momentos transicionales y que son plenamente compatibles con la Constituci\u00f3n Pol\u00edtica de 1991.<\/p>\n","protected":false},"excerpt":{"rendered":"
