{"id":39068,"date":"2017-07-26T15:44:31","date_gmt":"2017-07-26T20:44:31","guid":{"rendered":"https:\/\/www.dejusticia.org\/?p=39068\/"},"modified":"2017-07-31T16:00:34","modified_gmt":"2017-07-31T21:00:34","slug":"prison-is-not-the-only-sanction-in-transitional-justice-mechanisms","status":"publish","type":"post","link":"https:\/\/develop.dejusticia.org\/en\/prison-is-not-the-only-sanction-in-transitional-justice-mechanisms\/","title":{"rendered":"Prison is not the only sanction in transitional justice mechanisms"},"content":{"rendered":"<p>The design of the Comprehensive System of Truth, Justice, Reparation and Guarantees of Non-Repetition, which is part of the Special Jurisdiction for Peace (JEP), is in accordance with the 1991 Political Constitution and international law parameters for transitional justice.<\/p>\n<p>&nbsp;<\/p>\n<p>As\u00ed comenz\u00f3 su intervenci\u00f3n C\u00e9sar Rodr\u00edguez el pasado 6 de julio en la Corte Constitucional, donde se realiz\u00f3 una audiencia p\u00fablica dentro del proceso de control de constitucionalidad al Acto Legislativo 1 de 2017, que cre\u00f3 este sistema como columna vertebral de la implementaci\u00f3n del Acuerdo Final de Paz.<\/p>\n<p>Seg\u00fan Rodr\u00edguez, este sistema reconoce la importancia del componente de justicia penal para satisfacer los derechos de las v\u00edctimas pero tambi\u00e9n de la verdad, la reparaci\u00f3n (individual, colectiva, material y simb\u00f3lica) y las garant\u00edas de no repetici\u00f3n.<\/p>\n<p>Rodr\u00edguez hizo un llamado para que el examen de constitucionalidad de este Acto Legislativo se realice de manera integral. Enfatiz\u00f3 en que los distintos componentes de este sistema no pueden analizarse de manera separada, pues los mecanismos encaminados a obtener verdad, justicia, reparaci\u00f3n y no repetici\u00f3n generan un balance adecuado para garantizar los derechos de las v\u00edctimas.<\/p>\n<p>Adem\u00e1s, pidi\u00f3 que el examen de esta norma fuera ponderado, para permitir que varios de los detalles del dise\u00f1o institucional del sistema sean desarrollados por el Congreso a trav\u00e9s las normas de implementaci\u00f3n, y que los aspectos de interpretaci\u00f3n espec\u00edfica sean objeto de las instituciones que se creen.<\/p>\n<p>Para terminar, Rodr\u00edguez abord\u00f3 un tema que ha generado una profunda pol\u00e9mica: las sanciones que impondr\u00e1 la JEP. Insisti\u00f3 en que el derecho internacional no establece la prisi\u00f3n como \u00fanica sanci\u00f3n para las personas juzgadas por cr\u00edmenes internacionales, que se acojan a los mecanismos de justicia transicional.
