In 2016, there were at least ten episodes of massive fish mortality in this coastal lagoon, which is the largest and most productive in the country. And although scientists have reiterated that the cause is the salinization of its waters and the loss of oxygen, neither the Ministry of Environment nor the environmental authorities have made decisive and effective decisions to stop the crisis.<\/p>\n<p>&nbsp;<\/p>\n<p>Este ecosistema, declarado reserva de la biosfera y primer humedal Ramsar de Colombia (de importancia internacional), es la fuente de trabajo y alimentaci\u00f3n de unas 15.000 familias que est\u00e1n viendo amenazados sus derechos al medio ambiente sano, a la vida digna, al m\u00ednimo vital, al trabajo y libertad de oficio, a la alimentaci\u00f3n y al agua.<\/p>\n<p><iframe loading=\"lazy\" src=\"https:\/\/player.vimeo.com\/video\/192051457\" width=\"640\" height=\"360\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\" data-mce-fragment=\"1\"><\/iframe><\/p>\n<p><a href=\"https:\/\/vimeo.com\/192051457\">Grave degradaci\u00f3n ambiental en la Ci\u00e9naga Grande de Santa Marta<\/a> from <a href=\"https:\/\/vimeo.com\/dejusticia\">Dejusticia<\/a> on <a href=\"https:\/\/vimeo.com\">Vimeo<\/a>.<\/p>\n<p>Por esto, un grupo de pescadores de las comunidades palaf\u00edticas de Nueva Venecia y Buenavista (en el municipio de Sitionuevo), decidieron tomar la v\u00eda judicial para reclamar la protecci\u00f3n de sus derechos. El 10 de noviembre del 2016 interpusieron una acci\u00f3n de tutela contra 26 entidades p\u00fablicas nacionales y locales, denunciando que no estaban cumpliendo con las funciones que les correspond\u00edan para proteger este ecosistema.<\/p>\n<p>Los demandantes argumentaban que la crisis respond\u00eda a una suma de factores, como la presi\u00f3n de palmicultores, arroceros, bananeros y ganaderos; el precario mantenimiento y dragado de los ca\u00f1os que conectan a este ecosistema con el r\u00edo Magdalena; y el plan del Gobierno de construir en su ronda dos grandes proyectos viales: la doble calzada Ci\u00e9naga-Barranquilla y la V\u00eda de la Prosperidad.<\/p>\n<p>En una primera instancia, el Tribunal Superior de Santa Marta neg\u00f3 la acci\u00f3n de tutela \u201cpor improcedente\u201d. A pesar de que el juez reconoci\u00f3 que \u201cse evidencia un gran deterioro en la Ci\u00e9naga Grande de Santa Marta\u201d, sostuvo que el derecho colectivo al medio ambiente sano debe reclamarse a trav\u00e9s de una acci\u00f3n popular.<\/p>\n<p>Pero los pescadores no se rindieron. Presentaron una impugnaci\u00f3n a ese fallo, argumentando que la acci\u00f3n de tutela es oportuna cuando se busca proteger un derecho colectivo, cuya afectaci\u00f3n tambi\u00e9n lesiona varios derechos fundamentales. Y aunque en una segunda instancia sus argumentos tambi\u00e9n fueron rechazados, el pasado 18 de abril la Corte Constitucional seleccion\u00f3 el caso para tomar una decisi\u00f3n de fondo. Dejusticia acaba de presentar una intervenci\u00f3n apoyando los argumentos de la tutela y reiterando que esta acci\u00f3n es procedente.<\/p>\n<p>En nuestra intervenci\u00f3n, presentada en la Corte Constitucional el pasado 14 de julio, reclamamos la protecci\u00f3n del derecho a la vida, al trabajo y al medio ambiente sano de los habitantes de la Ci\u00e9naga Grande de Santa Marta quienes dependen de la pesca en este humedal para sobrevivir. Adem\u00e1s, le pedimos a la Corte que analice este caso, entendiendo las caracter\u00edsticas y din\u00e1micas de las comunidades palaf\u00edticas para quienes el agua no es solo su medio de subsistencia sino el elemento que atraviesa y permea todas las capas de la vida social.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The environmental crisis of this ecosystem led fishermen to pursue a legal battle that reached the High Court.
