Gloria Mansilla, esposa de Miguel \u00c1ngel, y sus tres hijas, interpusieron inicialmente una tutela ante la Corte Suprema de Justicia que buscaba defender su derecho a la igualdad, al debido proceso y a la memoria.<\/p>\n<p><iframe loading=\"lazy\" src=\"https:\/\/player.vimeo.com\/video\/152421327\" width=\"640\" height=\"360\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\" data-mce-fragment=\"1\"><\/iframe><\/p>\n<p><a href=\"https:\/\/vimeo.com\/152421327\">En defensa de los bienes de los desaparecidos. El caso de la familia de Miguel \u00c1ngel D\u00edaz.<\/a> from <a href=\"https:\/\/vimeo.com\/dejusticia\">Dejusticia<\/a> on <a href=\"https:\/\/vimeo.com\">Vimeo<\/a>.<\/p>\n<p>Despu\u00e9s de que esta tutela les fuera negada en la Corte Suprema, la Corte Constitucional seleccion\u00f3 el caso y lo decidi\u00f3 el a\u00f1o pasado. Pero su fallo tambi\u00e9n fue desfavorable. Entonces, Gloria Masilla interpuso una solicitud de nulidad basada en que la Corte no se hab\u00eda remitido a los precedentes adecuados para sustentar su negativa. De hecho, la sentencia de la Corte desconoci\u00f3 jurisprudencia suya sobre el deber de los jueces de tutela de flexibilizar el requisito del tiempo m\u00e1ximo que puede transcurrir entre la violaci\u00f3n de un derecho y la presentaci\u00f3n de una tutela, para personas de situaci\u00f3n de vulnerabilidad, como las v\u00edctimas de desaparici\u00f3n forzada y sus familiares (especialmente en casos donde hubo persecuci\u00f3n pol\u00edtica como la que vivi\u00f3 la UP).<\/p>\n<p>En este momento, la familia D\u00edaz Mansilla espera el pronunciamiento de la Corte sobre la petici\u00f3n de nulidad. Esta podr\u00eda ser la \u00faltima oportunidad que tienen Gloria y sus hijas para no perder la casa, que las une a la memoria de su esposo y padre desaparecido.<\/p>\n<p>En un pa\u00eds como Colombia, que tiene una situaci\u00f3n dram\u00e1tica de desaparici\u00f3n forzada, si bien ha habido avances en la b\u00fasqueda de restos de personas desaparecidas y en la persecuci\u00f3n de los responsables, a\u00fan faltan m\u00e1s desarrollos en los derechos civiles y sociales de las v\u00edctimas de desaparici\u00f3n forzada. Hasta ahora, la Corte no ha tenido oportunidad de referirse al alcance de la protecci\u00f3n en el derecho civil de las v\u00edctimas de desaparici\u00f3n forzada, como el derecho a la propiedad.<\/p>\n<p>Una decisi\u00f3n favorable en este caso no ser\u00eda solo beneficiosa para Gloria Mansilla y sus hijas\u00a0 sino para muchas otras v\u00edctimas que est\u00e1n a punto de perder sus bienes por deberle al Estado cr\u00e9ditos que dejaron de pagar despu\u00e9s de desapariciones forzadas de familiares suyos, a manos de agentes del mismo
