{"id":39839,"date":"2017-09-11T16:01:14","date_gmt":"2017-09-11T21:01:14","guid":{"rendered":"https:\/\/www.dejusticia.org\/?p=39839\/"},"modified":"2017-09-11T16:02:13","modified_gmt":"2017-09-11T21:02:13","slug":"focal-points-for-a-global-conversation","status":"publish","type":"post","link":"https:\/\/develop.dejusticia.org\/en\/focal-points-for-a-global-conversation\/","title":{"rendered":"Focal Points for a Global Conversation"},"content":{"rendered":"<div id=\"block-a8dcde01f45ec3085bcd\" class=\"sqs-block html-block sqs-block-html\" data-block-type=\"2\">\n<div class=\"sqs-block-content\">\n<p>During the last six weeks,\u00a0my colleague Camila Soto and I have talked to indigenous leaders who applied to the\u00a0<a href=\"mailto:http:\/\/www.consultaprevia.org\/%23!\/columna\/33\">First Global Workshop on Human Rights Strategies for Indigenous Leaders<\/a>, which is being organized by\u00a0<a href=\"http:\/\/www.odracial.org\/%23!\/index\">Racial Discrimination Watch<\/a>,\u00a0the\u00a0<a href=\"http:\/\/www.consultaprevia.org\/%23!\/index\">Information Center for Prior Consultation\u00a0<\/a>and\u00a0<a href=\"http:\/\/develop.dejusticia.org\/\">Dejusticia<\/a>. During these conversations,\u00a0we talked to leaders from very different contexts:\u00a0Filipinos with a high degree of experimentation who are including international actions within their mobilization strategies, Indian leaders facing hate speech \u2013 and hate practices \u2013 against their community who identifies as indigenous and Muslim,\u00a0Kenyan authorities asking the State to return them the land it took from them to convert it into safaris, and representatives of Mayan communities opposing the transformation of the Yucatan Peninsula into a large field of transgenic soy.<\/p>\n<p>Before highlighting the particularities of each of the experiences, I want to propose common themes that characterize the global agenda of the indigenous movement.\u00a0To trace the questions,\u00a0strategies, and similar solutions that indigenous peoples and their organizations share is also a commitment to a common conversation.\u00a0Here, I will present three points in common that came up during our conversations with more than 50 indigenous leaders.<\/p>\n<p>&nbsp;<\/p>\n<p><img decoding=\"async\" class=\"thumb-image loaded aligncenter\" src=\"https:\/\/static1.squarespace.com\/static\/58b835ef9f74566e1ddb7fe8\/t\/59b69c78e5dd5b52644f43da\/1505139840014\/?format=750w\" alt=\"A Ladakhi woman, part of the Tibetan ethnic group. Expand\u00a0the categories of the law to include indigenous identities.<\/strong><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div id=\"block-yui_3_17_2_1_1505137716718_48285\" class=\"sqs-block html-block sqs-block-html\" data-block-type=\"2\">\n<div class=\"sqs-block-content\">\n<p>The first recurrent point is how much of indigenous identity is covered by state law and how much is left out.\u00a0In the words of a Burundi leader &#8220;the category of indigenous peoples does not mean anything in our context,\u00a0but in the international stage we have to use it to seek protection.&#8221;\u00a0This debate, which is quite visible in Africa, is also replicated in Peru where the government published a\u00a0<a href=\"http:\/\/bdpi.cultura.gob.pe\/lista-de-pueblos-indigenas\">list\u00a0<\/a>identifying who is indigenous and who is not.\u00a0A group of Peruvian indigenous and human rights organizations sued this policy. Dejusticia, along with Stanford University, Los Andes University, and Peru\u2019s Catholic University,\u00a0presented an\u00a0<a href=\"https:\/\/develop.dejusticia.org\/litigation\/amicus-sobre-derechos-de-los-pueblos-indigenas\/\">amicus curiae\u00a0<\/a>explaining the unconstitutionality of the database.<\/p>\n<p>The common point in each case is that the state law only recognizes some forms of being indigenous.\u00a0When state forms become practical,\u00a0many indigenous peoples cannot freely develop the life projects that they dream about.\u00a0Whether it is be by imposing a decontextualized category or decreeing who is indigenous,\u00a0state law is one of the favorite tools of governments to reduce the scope of protection of these communities.\u00a0Therefore, a global effort could collectively focus on expanding the categories and increasingly poking holes in the monolithic and static definitions that state legal systems have developed to address indigenous issues.<\/p>\n<p>&nbsp;<\/p>\n<p><img decoding=\"async\" class=\"thumb-image loaded aligncenter\" src=\"https:\/\/static1.squarespace.com\/static\/58b835ef9f74566e1ddb7fe8\/t\/59b69dd759cc681cdd7e5035\/1505140188334\/8385591357_1f0df2113e_k.jpg?format=750w\" alt=\"Indigenous children in rural Cambodia. The struggle for land: land titles and use of indigenous territories.<\/strong><\/p>\n<p>Indigenous peoples have historically fought for collective title to their lands.\u00a0For example, in Central America,\u00a0they have developed\u00a0<a href=\"http:\/\/www.alianzamesoamericana.org\/\">programs<\/a>\u00a0showing that collective titles do not only have positive effects on indigenous communities, but at the same time, are an effective measure to protect the environment.\u00a0According to those interviewed, something similar has been done in Cambodia, where communities are developing collaborative projects between different groups living in forests in order to protect the land and secure indigenous land titles.<\/p>\n<p>However,\u00a0the classic agenda in favor of land titles becomes much more complex in conversations with Amazonian leaders because they too are wondering what to do with their recently recognized land.\u00a0Indigenous peoples are not only interested in obtaining land titles, but in developing projects that allow them to be autonomous in terms of food, protect endangered species, or obtain material fibers for handicraft production.<\/p>\n<p>Thus, one of the central points for mobilization can focus on the two-sided question of territorial rights: to ensure ownership and the ability to use the natural resources on their land.<\/p>\n<\/div>\n<p><strong>3.<\/strong>\u00a0<strong>Indigenous peoples propose other economic models and relationships with nature<\/strong><\/p>\n<div class=\"sqs-block-content\">\n<p>A final shared focus is the strategies used by indigenous peoples to destabilize the supremacy of the concept of development and the state hegemony to make decisions.\u00a0In Nepal and Uganda,\u00a0many of the actions that indigenous peoples take are to &#8220;show that the state and businesses\u2019 concept of development is killing us,&#8221; as a Ugandan leader said when I asked about her country\u2019s economic project.<\/p>\n<p>And with the economic discussion, comes the power of decision.\u00a0In most cases,\u00a0when the conversation turned to\u00a0<a href=\"https:\/\/develop.dejusticia.org\/publication\/human-rights-in-minefields\/\">extractivism<\/a>, we always talked about the\u00a0<a href=\"http:\/\/www.consultaprevia.org\/%23!\/columnas\">power<\/a>\u00a0of who speaks for whom.\u00a0Leaders from Bolivia,\u00a0South Africa, and Pakistan stressed that they are seeking state protection of their right to say no.\u00a0Although many references to the right to consultation continue to be made, peoples\u2019 perspective seems to be increasingly focused on consent.<\/p>\n<p>&nbsp;<\/p>\n<p><img decoding=\"async\" class=\"aligncenter\" src=\"https:\/\/static1.squarespace.com\/static\/58b835ef9f74566e1ddb7fe8\/t\/59b69f54f7e0abec5d38d0a7\/1505140629672\/4858725618_5e1d6d7445_b.jpg?format=750w\" alt=\"Cofan Indigenous leader Emergildo Criollo smells the petroleum contaminated river near his home in the Amazon rainforest. While they show the inequitable and unjust effects of the extractive economic model,\u00a0they can increasingly position their right to say yes or no.<\/p>\n<p>There is currently a lot of hope in promoting the common points of the global agenda of indigenous peoples, which combines questions and actions on identity, land, and development.\u00a0At the end of the day, the world has silenced them and embraced dredgers, mines, and pipelines for centuries. &#8220;Could it be that it now is time to embrace [a] holistic relationship between man and nature like the one our indigenous peoples have?
