Six months ago, Congress, via fast track, approved the Special Jurisdiction for Peace (JEP). This reform (Legislative Act 1 of 2017) transitorily introduced essential mechanisms for the political transition from war to peace to the Constitution of 1991. These changes, agreed in the Government’s Final Agreement with the FARC-EP, include: the Search Unit for Missing Persons (UBPD), the Truth Commission (CEV) and the JEP.<\/p>\n

 <\/p>\n

Desde ese momento esa norma est\u00e1 vigente y comenz\u00f3 a tener efectos concretos. Por ejemplo, se cre\u00f3 un Comit\u00e9 de Escogencia que est\u00e1 realizando la selecci\u00f3n de los magistrados de la JEP. Sin embargo, no hay plena certeza jur\u00eddica sobre su contenido. Y esa parte, que le corresponde a la Corte Constitucional, contin\u00faa en estudio. Todos seguimos esperando el fallo del Alto Tribunal.<\/p>\n

Para llegar a ese fallo, la Corte escuch\u00f3 la opini\u00f3n de instituciones y organizaciones de la sociedad civil a trav\u00e9s de una audiencia p\u00fablica celebrada el 5 de julio. C\u00e9sar Rodr\u00edguez y Rodrigo Uprimny, investigadores de Dejusticia, hicieron un llamado a la aprobaci\u00f3n de esta reforma.<\/p>\n

Adicionalmente, nuestra organizaci\u00f3n present\u00f3 una intervenci\u00f3n escrita a la Corte, en la que argument\u00f3 que se trata de una reforma plenamente compatible con nuestra constituci\u00f3n y que contempla de manera integral la justicia transicional. En la intervenci\u00f3n, adem\u00e1s, se solicitaron algunos ajustes a los requisitos para ser magistrado o magistrada de la JEP (Art. 7), a la competencia de esta jurisdicci\u00f3n para procesar a terceros civiles que participaron en el conflicto (Art. 16) y a la figura de la responsabilidad de mando (Art. 24).<\/p>\n

Mientras la Corte Constitucional segu\u00eda en su estudio, el Gobierno radic\u00f3 en agosto en el Congreso una Ley Estatutaria para definir las reglas de juego bajo las cuales funcionar\u00e1 la JEP. El 11 de septiembre tambi\u00e9n se realiz\u00f3 una audiencia p\u00fablica en el Congreso, donde diversos sectores sociales dieron sus puntos de vista en este debate: la mayor\u00eda apoy\u00f3 el contenido de la propuesta. Rodrigo Uprimny destac\u00f3 la importancia de este sistema judicial especial, \u00fanico en el mundo, porque por primera vez las dos partes negociantes se impusieron a s\u00ed mismas la obligaci\u00f3n de acudir a un tribunal a rendir cuentas de lo ocurrido en el conflicto.<\/p>\n

Tuvieron que pasar casi dos meses para que el Congreso citara al primer debate, que se realizar\u00e1 este 26 de septiembre. Y la Corte Constitucional sigue sin pronunciarse. Esta espera para que se consolide la que ha sido considerada la columna vertebral del Acuerdo de Paz, genera mucha incertidumbre e inseguridad jur\u00eddica, que no le hace bien a la implementaci\u00f3n del Acuerdo.<\/p>\n
